The Union Steps up the Pressure on Nova
The General Union held a protest outside the the Labour Standards Office in Osaka today and filed a complaint against Nova for delaying wage payments to its employees

According to the union, salary payments due in mid-September were delayed for some 4,000 foreign teachers and Nova notified them that the payment scheduled for the middle of this month will be postponed until Friday.
Pay was also delayed for some 2,000 Japanese staff in July and August, and they have yet to receive payments that were due in late September, the union said.
The union submitted a report to the Osaka labor office Sept. 27 claiming Nova is falling behind on paying employees in violation of the Labor Standards Law. The office has repeatedly called on Nova to pay its workers as scheduled.

Three more former students of the beleaguered English conversation school NOVA have sued it over repayment of funds for cancelled contracts.
The group of three filed a lawsuit with the Tokyo District Court demanding that the Osaka-based conversation school chain repay a total of 1.46 million yen because of unfair accounting practices when returning money when contracts are cancelled.
The lawsuit is the second wave of legal action against NOVA backed by a group of Tokyo lawyers working pro bono to help students of the conversation school who feel they have been mistreated.
The three plaintiffs in the lawsuit filed Monday are all company employees who live in Tokyo.
Comment: There is no escaping death for Nova now. Even if Nova somehow manages to prolong things with a cash injection, pressure from the union, press coverage overseas and at home, and lawsuits will ensure that it will never be business as usual for Nova.

A labor union representing teachers at scandal-hit Nova Corp. submitted a petition Tuesday to the Osaka labor standards authority asking it to seek an indictment against the language school chain and President Nozomu Sahashi for breaching labor laws.
The General Union asked the Osaka Central Labor Standards Supervision Office — an arm of the Health, Labor and Welfare Ministry — to have prosecutors indict both Nova and Sahashi for delaying the payment of salaries to foreign teachers.
A separate labor union formed by Nova teachers in the Tokyo metropolitan area filed a similar petition with the Shinjuku Labor Standards Supervision Office.
According to the General Union, wages for the school's 4,000 or so foreign instructors are usually paid in the middle of the month. But the September payments were delayed, and the company has told instructors that the payments for October will be delayed until Friday.

However, while the deductions have continued, there have been many instances where NOVA did not pay rent as it was supposed to and landlords are trying to evict teachers, union officials said.

The MM Center is open and has been all day. There were signs posted on all floors saying access was restricted to authorised personnel only, to keep out protesters, but at no stage have instructors scheduled to teach been denied access.

How have the General Union helped in any way whatsoever ? How much money have they recovered for teachers ? How will focussing public attention on all the shit going on help the company continue ? Because if Nova doesn't continue teachers will end up with absolutely zilch. What's the point in taking legal action when doesn't have any money ?
The General Union, as far as eikwa workers are concerned, has always been, and always will be, a complete and utter waste of time.
Union is a Hindrance
Nova doesn't have any money.
Nova workers need money from Nova.
If Nova can't generate money, then nobody gets paid.
Legal action against Nova or Saruhashi cannot generate cash.
Legal action against Nova or Saruhashi helps to worsen the situation because even more bad publicity can only make it even harder for Nova to make money.
Action by the union has made METI worried that students won't get refunded so invoking public criticism of them instead of Nova. Therefore the government now wants to give priority to the students when doling out the last scraps of available cash.
So, to union I would only like to say...KEEP THE FUCK OUT OF IT, YOU STUPID, USELESS, BRAINLESS BASTARDS, but I fear the damage has already been done.

I've never been part of the Nova machine but have been watching this drama the last few days.
I've never been part of a union either but can sympathize. These guys are criminals. Nobody is going to get any money, but someone needs to push for some kind of justice to reduce the chance of this crap happening again. How could things get to where they are? If Nova was having financial trouble, they should have been restructuring, cutting schools, gradually laying off workers etc. To keep on going until it was too late like nothing was wrong is sick. They were in fact stealing rent money, salaries, bringing new teachers to Japan that will never get paid, selling lessons they will never give....
If Japan has the slightest bit of justice, there has to be prison time for some.

This "crap" happens every minute of every day in every country where business/commerce takes place. There is no way to prevent companies going bankrupt (and possibly ripping off thousands in the process). It is the nature of capitalism. (And, you know what happened to communism).
So, the above kind of sentiment is, in effect, meaningless.
In some kind of defense of Nova, they never "stole" salaries or rent money until the ludicrous punishment meted out by METI made their position untenable. For over 20 years of their prior existence, whatever their faults (and, when it comes to employee conditions, you'll find many bigger faults in virtually all English conversation schools ALL OVER THE WORLD), they always paid salaries on time.

As far as Nova goes, all I know is that every time I compared jobs with Nova teaches to the eikaiwas I once worked at, Nova always seemed like the bottom of the barrel.
Bankruptcies are handled differently. I once worked for an eikaiwa that went under, but everyone got paid and everyone got the classes they paid for. To say they are all the same is ludicrous.
I did not follow the METI case, but if Nova could not operate under their restrictions, they should have said so. Instead, they refused to restructure, stole money from teachers salaries that was never used for the purposes it was intended for, kept taking money for classes they could not give, kept bringing teachers to Japan they could not pay etc.
There was ZERO attempt by any of the management to show any ethics whatsoever!

The jerk above was really lucky. Worked for a wonderful eikaiwa which unfortunately went bankrupt, but being under such magnanimous owners came away completely unscathed. Of course, there are loads of bankruptcies like that...not quite. Please show me the glowing reports from the staff at the now-defunct, Atoni, Toza, Bilingual, ABC, NEC etc., etc. Just where were the management "ethics", and those of the other millions of companies around the fucking world, when all their workers got well and truly shafted ?
In fact, please show me the wonderful testimonials from people who currently work at GEOS, ECC, Berlitz etc., etc. Management there shouldn't be smirking too much anyway...they won't escape the fall out from METI's mishandling of the affair.

I'm a 'newbie' as of this month and it's cost heaps to be here, I'm not rich and there will be no pay off, but as you say, shite happens. I was recruited without proper briefing on the company's financials because Nova had a recruiting quota to meet, and I understand that. I too think METI was harsh and wonder why Nova didn't negotiate a better solution. As of today I've lined up a job back home which I'm looking forward to, but I hope to return when the dust settles on Nova and work for them again in whatever form the new company takes. I don't condone what's happened, but I'm not ashamed to say I'm a Nova instructor and, yes, thanks Sahashi for providing the opportunity for a life changing cultural experience in the past. I do have a degree and other qualifications but I've previously been one of those longer term regular Nova teachers who moaned most of the time, tho the exit doors were never locked. They've been an excellent company, flexible, upheld the contract, paid on time, never failed to pay annual increments though I wasn't any brilliant teacher. There's only been three Nova higher-ups who annoyed the bejesus outta me, and they've had their 15 minutes of flame in the forums. A lot of bad is happening but I can't see the Japanese public being over sympathetic if a couple of thousand Nova teachers were to protest because their pay is so far late by a couple of days for perhaps the first time in over 25 years when the Japanese staff are worse off. However, I can see it from the foreign side, and hope everyone gets paid, including the salaried staff.

You fear the damage has already been done? Nova has been posting large losses for at least 3 years. The METI basically stopped Nova from generating cash months ago. The majority of management and administrative staff have walked away leaving what is basically the shell of a company. The company is in an incredible amount of debt. Staff haven't been paid in over three weeks. Even if Nova is able to secure some more money from the investment that Sahashi is banking on, it is not enough to clear their debts and pay employees. It's over. It goes without saying that there is no saving the company.
Even as bad as things are, it can still get worse. There clearly aren't enough jobs for all the teachers in Japan so a lot of people will need to collect unemployment insurance to get buy until they sort things out. Until Sahashi declares bankruptcy, that process cannot start.
There is no chance the company will survive. We had better hope that it closes down tidily. Sahashi will not do it on his own. He will continue to lie, steal and cheat until someone stops him.

I cannot believe some are still loyal to Nova at this point.
First, I do not know every detail of Nova. However, I do know what a company is scummier than most. Nova was hiring teachers, selling contracts etc. to the very end. The management refused to seriously restructure. They refused to budge in any way making it impossible for another company to buy them out.
This kind of thing happens way too much is Japan. That is because nobody goes to jail over it because nobody does anything. The union is right for demanding some accountability! People that just want to do nothing make sure this crap will keep happening.

Two meetings are open to both staff and teachers. The third will be for

6:30pm - ONLY open to students. The GU will be inviting a lawyer to discuss
consumer rights.

If, as feared, NOVA goes bankrupt, under the government Wage Protection
Fund, 80% of owed salaries are recoverable. The payment will not be

If you move house, they will not go out of their way to locate you. In the
case of bankruptcy, the union is able to provide the receivers with your

I'm not a union member but I
I'm not a union member but I have relied on them for advice and assistance quite a lot over the past couple of months. They told me, like everyone else, while they would like to have me as a member, the would help me either way. I didn't join because I need to keep all the money I have in my pocked but they have spent numerous hours helping me.
The only reason they exist is because the current union members have paid their dues over the years. I'm sure the person writing this letter doesn't complain when unseful from the union is posted on this site.
You took a shot at the information they have? They had hello work produce and booklet in English and Japanese just recently, they were the ones who helped people know where they stand with the eviction mess and even Nova are following their advice, the got the Labor Standards Office to accept a complaint (which they had been refusing to accept from individual instructors), and the list goes on.
Most of them are offering their time for free to help people. And you criticise them? What have you don't to help?

You selfish prick. You are as bad as Sahashi. The company will collapse in the very near future. There is really nothing left of it now. Anyone tricked into investing into Nova is going to lose their money. You would like this to happen so you can get paid? Granted we are in a tough situation. Ripping people off isn't the solution.

I agree with you about the Japanese staff. I don't see them out shouting in the streets yet. Now, I know after this post will follow lots of nasty comments about the Japanese staff and Japanese people in general, but maybe the Union shouldn't be rushing to make it into such a public spectacle (including someone in a pink bunny suit!). Their other activities like information meetings and offering advice about housing, etc. should be commended. But, I think the whole protest march thingy looked ridiculous. (Okay, let the flaming begin...)

Now, all I want to say boils down to these points.
1. Nova is (was) scummier than most companies. No company, particularly eikawas are prefect, but almost everyone I ever talked to, from teachers, students and even someone who was ripped off when they did business with Nova (this was years ago), gave Nova very bad marks. Obviously, everyone has complaints, but those about Nova were always the worst.
2. All this could have been handled differntly. When they were punished by METI (and they were having troubles before that), they should have been some kind of restructuring. HIS etc. had expressed some interest in the company. However, the management refused to come up with a meaningful restructuring plan or make any meaningful management changes. This doomed any chances Nova had of getting back on track. They instead lied and kept signing up students and hiring teachers that would never get paid. They showed no concern for anyone but themselves.
3. As far a punishment goes, I am not making and specific recommendations. This kind of thing happens way too much in Japan. This should be invested and any wrongdoing by the management should be vigorously prosecuted. Laws likely need to be reformed to. Any pressure the union can put on is a good thing although I do not think they will get anyone’s money back.

The Unions' actions now and in the past have done nothing whatsoever to promote employee conditions or company standards. What they are doing now is only diminishing any slim chance of the company remaining in business and in effect any slim chance of employees collecting any salary in the near future. And the reason for their actions is for their own self-promotion. The Union would be aghast if Nova were to keep going. Their actions do not create any pressure other than forcing the government to warn Nova to refund students before paying salaries. CAN YOU AT LEAST JUST UNDERSTAND THAT SIMPLE POINT ?

Such drivel ! The reason the stock price is trading at 30 yen instead of 3 yen is that there is a possibility that if they can make it through to December the company can remain viable. Taking money from new students ??? Nova are not allowed to have new students...that's the main reason why thousands of employees are not getting paid.

Well, you have calmed down a little but not much and still are rather rude!
What the unions actions have or have not done in the past has nothing to do with my point that someone needs to push for accountability here. Regardless, they are kicking a dead horse. The company is doomed because of the mess it got itself into.
From a high of 1750 to 30. Sounds like shareholder value has been pretty much wiped out regardless! Well, I agree the only thing preventing it going to zero is a tiny hope. That is a false hope though made virtually impossible by the actions of the management.
Now, is selling a product that you only have a very, very tiny chance of ever delivering the least bit ethical? Is bring people from the other side of the world to work jobs the will almost certainly never get paid for, for a company that at the very least will have to drastically restructure and greatly reduce staff, showing the least bit of humanity or concern for its workers?
Regardless, this is not an issue that is close to me personally and I have pretty much said everything I want to say on it. I will never understand how anyone could be so devoted to a company like Nova. It is your life and Nova is dead though.

You are right when you say
You are right when you say the Union activity harms the very slim chance the company has of surviving. Everyone is well aware of that and it has been considered. The benefit is, that by putting public pressure on the government agencies, Sahashi will not be able to drag this out for months without paying wages. Granted wages may never get paid, but it is even worse if the company does not declare bankruptcy. Wouldn't you agree?

I have a very strong feeling there is, and will be, many, many things you will never understand.
I am not devoted to Nova. I'm devoted to its salary, and I'm devoted to seeing a lot of its students (many of whom I like on a personal basis) not lose a substantial amount of their (in most cases) hard-earned money.
Nova has never been the perfect company to work for, but nevertheless, hundreds of thousands of Nova students over the years have been well-satisfied with the product they bought. Thousands of instructors have been able to get a foothold in, or taste of, Japan through Nova.
Some Nova teachers have become embittered with the company over the years and many of them (past and present employees) now wait like vultures for it to die. And many of those vultures are resident at the General Workers Union.
BTW, the government in power, and generally most Japanese businesses despise the unions. One union group headed by a menage of scruffy foreigners is going to have as much influence over future government policy as a candle in a black hole; and (behind any public niceties shown) will be treated like a dose of the clap in a whorehouse.

No, I certainly wouldn't agree ! Employees have rights similar to the company going bankrupt if salaries are withheld or not paid within a reasonable amount of time. In other words, an employee would be able to resign in circumstances that would mirror those of bankruptcy even if the company doesn't declare it as such.
Maybe the General Union doesn't want Nova employees to know that fact. I wonder why ???
I actually had an interview
I actually had an interview with Hello Work and they told me that Nova needed to be late twice before they would consider a termination Nova's falt. I for one think another month before even been able to start the process is far too long.

It is also worth noting that the longer it takes Nova to declare bankruptcy, the longer it will take for people to collect the 80% of wages paid back under wage protection laws. It can be as soon as two or three months if things close down smoothly, it can be over a year if they don't.

It would be totally different if there was still a hope of Nova recovering. Even if Sahashi pulls off the share deal next week, that won't get Nova out of debt. Sahashi ran Nova into the ground and there is no saving it. Clear and simple.

Stating the obvious
Nova's continued hiring of instructors and continued attempts to sell lessons is based on the blindingly obvious point that it's the only way the company can continue.
Granted that most people on here don't want Nova to continue, but those remaining in management do want the company to continue. To do that they need cash, which only comes from selling lessons, and they need instructors to teach those lessons, which requires new instructors because so many have jumped ship. They are partly responsible for what they are criticizing. Of course, I realize there is no chance of them ever admitting that, but that doesn't make it any less true.

Would said wages have been paid anyway? That is something that we can't really know, but the GU has been hosting a lot of press conferences to HELP keep the plight of the teachers in the news so that all of the focus is not soley on the business in and the students. THAT is a help to EVERY teacher in Japan, in and out of NOVA. The public must constantly be reminded of the stress this is causing on the foreign workers, and even people that hate the GU must admit that making noise is a specialty of the GU.
Any NOVA teachers (or staff members) who want/need some help should contact the GU. We (when I say "we", I am speaking as an individual member here, not as a someone who is in charge of the NOVA issue) are really slammed with new applications now, and all of the demands for contact have been hard to meet lately, but we will, as always, do our best to help (and if you think our best isn't good enough, then join us and lead the way).

Teachers weren't paid on Friday.
The best thing for any Nova teacher to do would be to find work elsewhere.
Even if the wages already due are paid (eventually) next month will be even worse. It's not going to get better, at this point, as the restrictions on Nova will prevent any action that might inject a large enough amount of cash to pay what's already owed.
Today is the 19th. Nova already owes all its teachers and staff 19 more days worth of wages on top of what it's struggling to pay for this month.
It's not going to get better, so if you're working for Nova still and think it will blow over, start making alternative plans now.
I do think there will be enough jobs for the teachers who are in Nova, but we might have to spread out a bit. More companies will hire more teachers as students spread from Nova to other companies.
It's not the end of the world, just a company.

but I've been reading a lot of comments on this site, and many of them seem so hateful and irrational. I guess I felt a little defensive. I think I'm going to skip reading those and focus on the intelligent, useful comments!

dude. you dont have a clue. the amount of processing time that it takes to process a new member is worth FAR more than a thousand yen. at a recent meeting of over 100 NOVA people and the GU, Dennis Tesolate told the crowd that:
'of course the union would like to have new members, but DON'T join the union if you only need help on this issue; if you are going to join the GU, do it because you want to be in the GU. we are extremely busy right now so dont join just for this one problem. we wont turn people away who only want help on this one issue.' (a rough paraphrase, this is not a direct quote)
after that meeting, nearly half of the people joined. the majority didnt and that was fine. the GU still intends to help everyone that needs it. paying dues is not a requirement of getting help on this issue.

the plan is to evaluate the situation again after three months. if the situation is still the same (or emperor forbid, WORSE) the offer will no doubt be extended...
if you don't need the help, good for you, but don't go insulting good peoples' good will just to show how well you can blow off some misguided steam...
and as always, if you have a better plan, step up to the plate and lead...
Nova Union Site Suspended
Out of curiosity I just went to the Nova union website and it sent me to a site that said "Nova Union Website Domain Suspended" in bold letters. Not sure if this was a glitch or what, but doesn't encourage a great deal of confidence.
NOVA UNION
There was never a NOVA Union. It was all just a cover up for not showing up for work. These guys were genies. They called it a Union and told everyone we are striking to protect your rights but in reality when they were "Striking" they worked somewhere else where they earned more than at Nova.
Anyone seen them lately at the trenches??? Or are they just hiding together with the monkey? These guys were the reason I never joined the Union!!!
The Union and other dirty inner workings...
The Union and complaints (students/anonymous phone calls/etc.) were Sahashi' antennas. Ever had a teacher that claimed he was from a so and so school and so and so's friend, speaking in a British accent, coming to one of your "NOMIKAIZ" drinking parties and you never saw him again!? He was Sahashi's (eyes and ears) infomation gathering agent, a mole! I was screwed by one such occasion. Glad I lost my job back then!! Don't think it doesn't matter any more! Beware of what you say openly to people you've just met in these (big) schools/companies in Japan, Seen it happen many times!
