Sahashi Out on Bail

Sahashi has made bail and has been released.

The Osaka District Court on Thursday granted bail to Nozomu Sahashi, former president of now-defunct language school operator Nova Corp., who was indicted earlier this week for embezzlement of corporate funds. Sahashi, 56, immediately paid 50 million yen in bail.

Sahashi’s lawyers had sought his release on bail after prosecutors indicted him Tuesday. According to the indictment, Sahashi, who was arrested in late June, diverted around 320 million yen from an employee benefit fund on July 20 last year to reimburse tuition fees to people who canceled contracts for language courses.

Comment: Not much to say except for the fact that G.communication must be wincing every time the name NOVA appears in the press because good news and NOVA do not go together. The decision to keep the NOVA brand ranks up there on the list of All-Time Stupid Business Decisions.

The fact that he can still pay it out that quickly shows just how poorly we all got paid. And by all I'm including the J-staff and the 'titled instructors' with their whopping ichiman a month raise. And by poorly I mean that that asshole could have paid us all of our wages due and not the partial payoff we got from the government (appreciative as I am for that, the Labor Bureau did right by me). The government ought to take all his loot and reimburse themselves for having to pay all of NOVA's employees.

One of my current business students tells me that paying out of pocket may be what he has to do. Don't quote me on it, though.

Now THAT'S the obvious question.

Canadajin, haven't you ever heard of 'incoporation'? Do you have any clue what that means? NOVA, for all its faults, was a corporation, right? So why would you think that Saruhashi wouldn't have any personal assets just because NOVA went bankrupt? He was the president of a wildly successful business for many years, and I'm sure he made plenty of money. His PERSONAL assets are not the same thing as the COMPANY assets. If the company goes under he is not PERSONALLY liable for any of the losses. That's what incorporation is all about.

He may be criminally responsible for acts such as embezzlement, etc., and may have to do jail time. Furthermore, if any NOVA teacher wants to personally sue Saruhashi in a civil case, well, that's their prerogative. But the simple fact that NOVA failed, even that Saruhashi's own mismanagement was a major cause of the bankruptcy, will not win a personal damages suit against him. That's what corporate law is all about. NOVA teachers may not like it, but incorporation protects personal wealth from the claims of creditors and lawsuits.

But just admit the fact that you know nothing of law, finance or business. Your righteous anger doesn't hide that obvious fact. For supposedly college educated people, most of you are incredibly ignorant.

i DO know that trying to run a company only hiring (or promoting-from-within) art grads, computer studies grads, theatre majors, or piano players, then expecting them to adequately fill the roles of supervisors, educational RnD, middle management and accountants (ie Business and education majors) is pretty fucking stupid isnt it?

i also know that treating employees like a chain of never-ending bottomless-pit replaceable cogs is going to have an eventual detrimental effect on hiring, as they go home, and tell 2 friends not to work for Nova, and then they tell 2 friends..and they tell 2 friends..and so on and so on..and so on...is pretty fucking stupid isnt it?

i also know that a top-down corporate structure that is inflexible and indifferent to the experience and needs of the workers is more likely to fail.
