Legal Team Gets Ready to Sue
The wheels of justice keep on turning. A class action lawsuit is in the works and the legal counsel representing Nova students (the NOVA higai taisaku Osaka bengodan) appears to be preparing to go after everyone involved with Nova's collapse.
According to the report, the lawyers held an information session in Osaka last Friday where they were considering a class action lawsuit against former Nova president Nozomu Sahashi and his executives, METI (the ministry that had regulatory authority over Nova), and the Nova trustees.
Nine individuals have formally signed on a plaintiffs with more than 30 others thinking about joining the group. The lawyers also said that they will demand that credit companies refund students their unused lessons.

英会話学校ＮＯＶＡが経営破たんした問題で、受講生を救済するための被害対策大阪弁護団が２２日、損害賠償請求の集団提訴に向けた説明会を大阪市の大阪弁護士会館で開いた。
弁護団は集団提訴で責任を追及する対象として、猿橋望前社長ら旧経営陣のほか、監督官庁の経済産業省やＮＯＶＡの監査法人についても「可能性を検討する」とした。
この日は９人が正式な受任契約を結び、前向きに検討している人も含めると３０人以上が原告団に参加する見通しという。今後、一定の時期で受任を締め切り、提訴に向けた調査を進める。
またクレジット契約を結んでいた受講生については、信販会社に対し未受講分のレッスン料返還も求める方針。
原告団に加わる予定という奈良県河合町の女性会社員（５８）は「１年半分くらいのポイントが残っていた。今は別の学校に通っているが、このままでは腹立たしい気持ちがある」と話した。（共同通信）

Just curious, but when are the former employees of failed Nova going to get on the ball and form their own legal team? I'm not saying that they haven't, cause I don't know, but if they have I haven't heard anything about it...
Everyone wants there money back, and last I heard Sahashi still has his...just a thought.

The lawyers will make money out of this. They will be the only winners. My guess is most of the money is simply gone. I suppose the monkey deserves this though. I seriously doubt anything else will change.

a terrible failure of the legal system.

but hopefully they can at least get debts forgiven
from "unrelated" credit companies who
were cashing in on the Nova scam, in their own way.
Likely with full knowledge, cooperation, and kickbacks
to Saruhashi.
Maybe get those debts transferred to the Saru-man.

I'm glad to see that they're going after METI and the trustees as well as Saruhashi. He deserves most of the shit to be dumped on him but they played their part as well.
Why the Trustees?
It's interesting that they're going after the trustees. What's the rationale behind that? Obviously, the Trustees didn't come into the mess until after the company declared bankruptcy, so I'd like to know the details of the complaint against them.

I could think of plenty of reasons. Don't forget that when the trustees took over Nova, they didn't fire instructors. They kept them on the books and should have paid them for that time. They broke all the same laws that Nova did. Sure, not to the same extent, but they still screwed people over. That's not mentioning the latest backdown when it came to G.Ed's promise to reemploy all instructors.

But the people filing this class action aren't instructors, they're former customers. I want to know why they're doing it.

Why they're doing it...
Why are the students going after Saruhashi, METI and the trustees? Possibly because Saruhashi took all their money and didn't provide the lessons they'd been promised, because METI pretty much allowed him to do it, and because instead of ensuring they got their money back the trustees left them in the hands of a company that wanted even more money from them.
The students should take these useless fuckers for everything they've got.
