Sahashi Admits to Delaying Salaries

The Asahi Shimbun has reported that the Osaka Labour Bureau questioned former Nova president, Nozomu Sahashi, on November 2.

According to the article, Sahashi admitted to not paying the salaries of the Japanese staff and foreign instructors. The Labour Bureau will also question the current management team to establish if they also violated the law.

During questioning, Sahashi admitted to delaying the payment of salaries because of Nova's severe cash flow problem.

According to the General Union, Nova has not paid some 2,300 Japanese staff their September and October salaries and approximately 4,400 foreign instructors their October salary.

The Osaka Labour Bureau has issued four warnings to Nova concerning the late payment of salaries. On October 23, the board heard the testimony of two Japanese staff and two foreign instructors and confirmed that salaries had not been deposited on the established paydays.

関係者によると、猿橋前社長は同社が会社更生法適用を大阪地裁に申請した後の10月下旬、同労働局の聴取に応じた。前社長は遅配行為を認めたうえで、理由について「資金繰りの悪化」などを挙げたという。

外国人講師の一部が加入する労働組合「ゼネラルユニオン」(同市)によると、NOVAは日本人従業員約2300人の9、10月分の給与と、外国人講師約4400人の10月分給与をそれぞれ支払っていないとされる。

同局はNOVAの給与遅配が始まった7月以降、4回にわたって是正を勧告。10月23日には、従業員2人と講師2人から事情を聴き、NOVAが毎月の支払日に給与を振り込んでいなかったことを確認していた。

Instructors haven't been paid our September salary. Technically our October salary isn't due until November 15th. Nit-picking, I know, but surely if people are goiing to report on this they should at least get the basic facts correct?

1) Nova can't find a sponsor, declares bankruptcy and we (eventually) get 80% of back-salary from the government (indirectly)
2) Nova finds a sponsor and they pay all back-salary.
3) Worst case scenario - Nova finds a sponsor and they don't pay back-salary.

I hear their lead article tomorrow is that the world is round...

Where were these "investigative" reports two montha ago? Jackasses.

One report was how the instructors were "cooking" until late and were putting out their unburnable trash on the wrong day.
I was wondering why they are on this clean up our language schools crusade.
Maybe connected to some rival eikaiwa???

Ok, will everyone please stop recylcing the same joke over and over in various forms. We all get the fact that this news is no news. It is far too late (and inaccurate) to be considered responsible journalism or even standad journalism but at least it promotes our cause even if only by a little.

Nothing we have heard lately is news. There probably won't be any NEWs in the near future. I'm sorry but I don't have anything new for you either except a couple of questions:

1. Is that 80% of what we get paid a month including all our allowances (regularity etc) or is that 80% of our base salary?

2. For those of us that have resigned, how long do we have to wait before we can claim our unpaid wages?

The facts are correct, ding-dong! Thousands of others and I haven't been paid for services rendered to the company in neither the months of September nor October. However late they may be, they are facts none-the-less.

As to question #1, 80% of unpaid salary of the last 6 months will be paid by Japan Labour Health and Welfare Organization, which is a government subsidiary. Remaining 20% must be collected through the bankruptcy administrator by yourself.

To get paid, you have to get a "certificate of unpaid wage" made by the bankruptcy administrator. Then fill out the application form, and send it to JLHWO with the certificate. The page says, "the money will be sent to your account in about a month from the application day."

I look to this website every now and again to find nothing special. Thanks for all the lack of info and waste of time. I can go back to scratching something.

But on the bright side, the NOVA.jp site has some useful info regarding the fact that Sahashi was in hiding until recent. Acknowledged he needed to come clean and made an appointment to spill the beans. As to why that is news, because he was hiding you imbeciles! Had he not been hiding it would have been as you so gently put it, stupid.

My question is whether it is 80% of the paycheck I receive INCLUDING allowances such as the service allowance, shift allowance, regularity allowance and regional allowance or whether it is just 80% of my relatively pathetic base salary.

Technically, our salaries are just our base salaries which is about 70% of our total pay. Everything else is an allowance. I am worried that we will only receive 80% of 70% of our pay check and our allowances will not be included.

Does anyone know what the deal is?

Amazon, 7-11 and a full list of convenience stores in Japan have recently started selling a xenophobic and racist magazine that among many other things makes liberal use of the N-word. Fukumimi expresses his outrage at the Eichi trash publication that is widely distributed across Japan:

Your October salary isn't late. It isn't due to be paid until November 15th. When (not if) we don't get paid on November 15th, THEN our October salary will be late.

The article mentioned Sahashi was questioned on November 2nd. Where did this take place? (obviously not in his lavish office in Osaka) Did Monkeybrains phone in to the Osaka Labor Bureau (seems to be his preferred method of dealing with people)? If he is in police custody like someone said why isn't it in the news?

Anyone with facts...please share it would be appreciated...

If that comment was posted as a response to my post I would like to point out that the article states we haven't been paid for October. As we all know it was September we weren't paid for and October that we won't be paid for. There is a big diffrence between not being paid for October and not being paid for September, namely one extra month of trying to survive with no money.

I have ploughed the internet looking for news of Saruhashi being in police custody and can only assume it is an outright lie or some poor fool has misinterpereted the fact that he was questioned. The questioning took place in person at the Labor Standards Office not in a police station and as far as I can tell he was free to go afterwards. If this is not the case please post a source link. It's hypocritical to bitch about the poor journalism when we start reporting BS to each other too.

Any takers on the 80% question or does smeone want to post a real topic or opinion? Jokes are only cool if they are funny and not repeated in various forms. We got it the first time and it wasn't that funny then!

Let me contribute by adding this link to the Japan times which now estimates Nova's debt at over 100 billion yen due to assets only actually being worth 10% of their book value. What are these assets? Books! I think they will find that even 10% is overinflated as the books are barely worth the paper they are printed on.

Thanks for the answer. It's good that it is 80% of our gross salary ie pre-tax salary. But the real question is whether they will also pay our allowances.

Please understand that technically the allowances (regularity, service, regional and travel) are NOT salary. That means if you work an A37 your base salary (read salary) is only 190,000; A34 is 170,000; Type B is 146,000; and Type C is 70,000.

Will the government pay 80% of our allowances too, even though technically and legally they are NOT salary but allowances akin to bonuses. I'm hoping for 80% of both my salary AND my allowances. Does anyone know the answer as to whether or not we will be paid the ALLOWANCES too?

On another note, it looks like NOVA is setting Saruhashi up to take a big fall. Here is a summary of the latest press conference courtesy of the NOVA website so it's as official as you can get!

I hope all those waiting for Nova's answers know that you are not going to be paid for this period while the schools are closed. Also, I wold like to point out that if a sponsor is found it is likely that you will all be dismissed and will have to reapply for your jobs. This comes straight from the trustees:

*please note the student who is waiting to return if Nova reopens. He basically implies that the reason Nova is suffering is because of the bad teachers... although there are some reasonable ones. I don't disagree about teacher quality, but come on man, the company owns a good 90% of the blame, maybe teachers own 5%, and i'll allocate 5% to those corrupt people in power who turned a blind eye right until the last minute. Despite what people say, Nova deserved the sanctions for REPEATEDLY violating the law. It was the poor business model and greed of the president as well as the board of directors that caused this fiasco! Lundquist included!

At the aforementioned interview they also stated that we might not get paid our unpaid wages by the new sponsor (if one is found). This contradicts a post that I read earlier where an individual stated that the Trustees will not consider any sponsors who will not pay back wages. But the Trustees must apply something called the public benefit test when making their decisions and finding a sponsor who can bail most of the company (excluding unpaid salaries and maybe even refunds) may be held to be in the public's interest. The trustees may be found to be negligent if they turn away such a sponsor.

Either way, we should see some money, even if it is from the government. The only question I have is how much longer will it be before we see some money? Even those of us who have saved and/or found new jobs might not be able to wait this out!

Salaries will not be paid. It is now time for the government to start revoking the visas held by Nova teachers. They couldn't work hard, and their company went out of business. Attempts to pin the blame on a Japanese man are sad.

Just in response to 3kun's pathetic little xenophobic post. The poor little Japanese man who doesn't do anything wrong is the real victim here! Saruhashi is no more than the modern day equivalent of those poor innocent Japanese soldiers accused of the Rape of Nanking (Otherwise known around the world as the 'Nanking Massacre' or widely denied within Japan as merely the 'Nanking Incident')!

I immediately saw my brother Saruhashi er I mean kunt's point! Leave the poor man alone AND leave Japan now! There were no war atrocities and Nova failed because of its foreign teachers and them only!!!

The Japan Times has reported that Gaba has offered to take Nova students until December 28 at a rate of 10 lessons to 1.

I am happy that the students will have a chance to somehow redeem their points but can't help feeling it is a case of 'out of the frying pan...' Without Nova, Gaba is the undisputed bottom feeder of the eikaiwa world! They treat their instructors (many of whom are not even native English speakers) like sh*t and engage in business practices that will one day be its downfall due to poor modelling on the worst parts of Nova. Indeed, cracks are already emerging and their plans for rapid expansion remind me of another failed English school... what was their name???

Nova rehab quest finds 12 sponsors
OSAKA (Kyodo) Twelve companies have applied to sponsor the rehabilitation of Nova Corp., the failed foreign-language school's court-appointed administrators said Saturday.

Some of the companies made specific proposals for turning around Osaka-based Nova, they said. Nova was granted protection from creditors Oct. 26 under the Corporate Rehabilitation Law.

The administrators said they plan to choose a sponsor at "an early stage next week." But they haven't finished assessing the value of Nova's assets yet, making it uncertain whether Nova's rehabilitation will proceed smoothly.

Today in one of the Japanese newspapers wrote; in the year 2005 & 2006, when NOVA was in the red, Sahashi received 350 million yen in bonus pay, 95% of what was paid to the Board if Directors, the rest received 5% divided between them.
Also, Sahashi's lawyer officially states, "The lavish office is/ was a showroom." (????????)

Just in case anybody thought that Nova will be ok. Even with sponsorship, we will see a very sick and crippled Nova that might survive a little longer but a company with debt in excess of 100 billion yen and no assets other than books (not a single one made Oprah's list) and such a bad reputation is quite simply doomed!

But what do I care?
