Please Keep Waiting

Despite the demise of Nova, teachers are still in limbo. Nova has released two announcements on its website explaining what will happen in the next month. The announcement on the appointment of interim trustees can be found here [PDF]. An FAQ for teachers is [PDF].

To summarize, the trustees want you to stay at home and wait while they look for someone to buy Nova. In the meantime, this means that there is zero chance of you getting paid, and this is spelled out in the FAQ document.

Q. Will salaries be paid?

A. It is with regret that we have to inform you that Nova does not have sufficient funds to pay salaries at the present time. We are unable to give an assurance that the company will pay salaries.

Q. Why are you asking us to stand by at home when you can't guarantee that salaries will be paid?

A. As a trustee, appointed to maintain the company's assets, it is necessary for me to close all the branches so that we can immediately investigate whether it is possible to reorganize and reconstruct the company by looking for an appropriate sponsor. Therefore, we ask you to wait at home and stand by.

I don't known how bankruptcy works in Japan, but I am not optimistic of the trustees finding a receiver soon. Nova does not produce anything tangible of value. Tack on its 43 billion yen in liabilities, the lawsuits filed against it, and the irreparable harm done to its brand and you can see why Nova is unattractive to prospective buyers. And this is probably why to ask the government for help in bailing the company out. They realize that the odds of finding someone aren't good. As mentioned in the recent Toyo Keizai article, the only real assets Nova seems to have are the 15 billion yen in shikikin and hoshoukin deposits it stands to receive upon closing a lot of schools.

So, teachers are once again told to wait. This is how a "precious social asset" is treated. How are they supposed to wait at home or check the Nova website if they have no money to pay the rent or utilities let alone eat? How many teachers now find themselves in this situation?

One Nova teacher, Alan Entwistle, 22, originally from the Wirral, told the BBC News website how he and his girlfriend Amy Jenkins were hit by the company's collapse.

He said: "Neither of us have been paid for October and we've been told we've got to leave our apartment at the end of the month.

"We've ended up pawning some of our clothes. Now we are dependent on Amy's savings. It's a heartbreaking situation to be in."

The immediate choice for teachers is to start collecting UI and start looking for a new job. As has been mentioned, if you quit of your own volition, it'll be three months before you see any money. However, Nova's nonpayment of salaries is reason enough that Hello Work should allow you to immediately collect unemployment benefits. Contact Nova, and get your paperwork together and file for UI. And then get out of Nova as fast as you can.

Edit: It looks like the Nova Union is about to set up a fund for instructors that would provide them some money.

Has anyone heard that JMA is canceling all policies at the end of this month?

Any ideas about alternate insurance options? I could not find anything on the union website even mentioning this. Supposedly there will be info on the NOVA site but I have not seen anything yet.

At the moment we are all still considered employees of Nova.
On November 5th if the company declares bankrupcy and goes into liquidation...we will all be dismissed so it will be possible to get ui quickly.

If you quit and apply now, you have to be able to prove salary was paid late twice to able to get ui. The problem is proving it. If you look at Novas contract, it states salary will be paid on or about a given day of the month. It doesnt state the 15th of every month.

Has anybody had success getting ui? If so how did you prove salary was late?

If you are worried about insurance, try out the city office and see if you can apply for National Health like we were supposed to when coming to Japan, But NOVA decided for us that we wanted a cheaper option. It may be too expensive now that you haven't been paying into it, but it's worth a look. Worst situation, go to the emergancy, They need to patch you up before booting you out. Only a cold, good luck till NOVA sends out the letters that They mentioned on the phone to me at the labor office.

I feel that the reason they want the teachers in Nova accommodation's to stay put is so they know where to look when you starve to death. It could also be that the immigration office can find you for deportation when they reject your visa.

No joke, if you are out of food, check a church group (usually has soup lines, like the one in Kanai). Generally they are English speaking and more helpful with the support than most governments. Though you might need to suffer a sermon or two.

If I were you, go to www.gaijinpot.com they usually have an advertisement about an alternative insurance carrier in Japan. It is equivalent or better than JMA. Please review it as soon as possible.

Unfortunately, the "10 days" that was originally stated by the trustees does not appear to be the case. They seem to have said one thing to the staff at BOTH Osaka meetings, and then another to the media.

As a MM employee who was present for what looks like the final Nova lessons ever taught, I can say that in both meetings (the first being for MM center employees present at the time - morning shift Friday, the second for everyone) they stated that they would try to find a sponsor/savior/etc, but if they could not after ten days, they would end the company. They made this fairly apparent, knowing that the staff was already at the end of their rope.

However, if became apparent in todays Osaka General Union meeting that they said another thing entirely to the media. Even the General Union was repeating the "one month" line, counter to what I heard on two separate occasions.

Even if it takes one month to formally bankrupt this company, even worse ideas are floating around. One broad one is if someone does buy the company but, through some legal loophole, does not pay salaries. In this case, since the company continues, we do not get our 80% of up to two months salary.

For those who are remaining in Japan, continued action and attention is necessary. Simply accepting unemployment insurance and taking a hiatus could forfeit your past wages. Stay active, stay informed, and if such a situation occurs that could hurt your chances at getting what you worked for, organize and let your opposition be known.

PS: Also, at the General Union meeting, one thing I remember is that they mentioned that (it seems) the two month late payment thing is no longer valid - Nova is in bankruptcy protection, which I guess means that that is enough to then resign and get unemployment. Please confirm this with your local office before actually submitting your resignation.

I am going to Hello Works to formally apply for UI. I resigned from the company earlier this month. I will let everyone know how soon we can receive our money. Please keep in mind that the amount will vary due to how long you have been working for the company. I had worked for the company for more than 4 years so, I am eligible to receive up to 8 months and 80% of my previous salary/ per month. Anyone who is going to apply must understand that they must have worked for a minimum of 6 months to receive any compensation from the government.

Key point:

According to my student, he mentioned that if you go to the Labor Stardard board in Chiba or in Chiyoda-ku you should be able to collect your unpaid salary from the government and in turn the government will go about the Monkey.

Shawn, what is your obsession with NOVA failing? I know they are/were a bad company, but you're not at all objective about any of this It's your blog, so you're free to express yourself. But I'm just curious.

In the last 3 months I don't know how many times I've read from you that 'this is the end,' or 'this is the last nail in the coffin,' or 'there's no hope now.' NOVA was troubled so, finally, after 20 or so such predictions, you got it right. But there seems more than a little glee in all your gloomy predictions.

For starters, 43 billion yen might sound like a large sum or money for you or me, but it's small potatoes for a big retailer like AEON, a likely buyer of NOVA. AEON generates revenues of around 120 billion a year so assuming the NOVA debt is no problem. In fact, I would guess that AEON carries a LARGER debt burden as part of its normal operations! Having NOVA schools in their malls obviously has brought in a lot of customers for AEON, so there is a great incentive for them to keep them around. Maybe they would change the name of the school, or just do a major overhaul of its image, but this is completely do-able and not a big risk for a corporation the size of AEON.

And as for NOVA not 'producing anything tangible of value,' welcome to the 21st century! Many of the world's largest corporations don't 'produce' anything, either. This is called the service sector, and it is HUGE! NOVA offers a service, one which is highly sought by Japanese consumers. The temporary shut-down of NOVA isn't going to suddenly make Japanese want to study English less, not in any appreciable way. NOVA already has offices, staff, a whole infrastructure in place. If AEON likes having an eikaiwa school in its many shopping malls it makes much more sense to partner-up with NOVA (yes, debts and all) than to bring start a new school chain from scratch.

Nothing can 'forfeit' your past wages. You worked and NOVA is responsible for paying you. If they can't then they can't, and that's that. But you are not 'forfeiting' your pay by accepting unemployment, and it will not put you any lower in the pecking order if NOVA assets are sold off to payback creditors (and students, and staff).

People, don't trust everything you read on these boards. Most of the people here do not really know what they are talking about, even though they act like they do.

Maybe you havent been keeping up on current events, but, the teachers are all about to go home. The J-staff have to find other jobs NOW. They cant starve to death waiting for some NOVA ressurection that will never happen. NOVA doesnt own its offices! They are rented and back rent has not been paid! Schools have allready had thier NOVA signs taken down all over Kansai so they can be let out to paying customers.
No one in thier right mind (let alone a competing eikaiwa) is going to pump that kind of money into NOVA so that they can reimburse former students, and pay staffing back pay. If anyone had that kind of money and the inclination to get involved in the eikaiwa business, they would start with a fresh debt free company. DO NOT OVERESTIMATE THE VALUE OF NOVA'S TAINTED BRAND! it is not worth its weight in piss!

It looks like the gov't is going to pitch in on Nova's behalf, but in a very reluctant and peevish sort of way.

They'll give them bankruptcy protection and help sniff around for a buyer, but it's not a true bailout. Judging from the tone of statements made by gov't reps, an assessment will take place to detail Nova's demise and check on the damage done to the language instruction industry in general. That sounds less like 'wholehearted support' and a lot more like 'oblique investigation'.

Their wording also suggests that gov't support is partly contingent on Nova being a listed company. Jasdaq has basically said Nova will be delisted in a month or so -- the subtext points to Diet support evaporating when that happens. I think the gov't is saying 'We're keeping an eye on things because a lot of people are watching. 2 weeks and we drop this wreck like a hot potato.'

Judging by the severity of Nova's condition, the dubious support offered by the gov't, and the absence of interested buyers, I'd say that Nova is done. The feds will perform a thorough autopsy, then look at other ways to revive the industry. Maybe if Nova had significant property holdings or other assets, they'd be worth being bought by a private equity fund or something. As it stands, they have their liabilities and a surplus of rabbit dolls.

That said, I am surprised the feds are doing as much as they are. There is the possibility Nova will be resurrected. If so, I don't think it'll bear any resemblance to the Temple of Usagi.

Please accept the situation that I was posting about - not if the company goes under, but if a company comes in, takes over the company, but refuses to pay past wages.

Basically, a company as dishonest, if not more, than Nova.

Also, I stated that taking a hiatus and ignoring such a company, *hoping* such a company would pay wages, would forfeit your wages. Doing nothing against another Sa(ru)hashi means more of the same, the protracted waiting period (if that), ending in us getting nothing.

This has NOTHING to do with unemployment benefits.

This was one of the more negative scenarios briefly (unfortunately, only brief) discussed in the Osaka General Union meeting. I don't think that it really could have been discussed longer as the possible scenarios are nearly limitless and depend upon all of the possible investors and their intentions.

I followed by saying that taking actions (protesting, making your voice clear), instead of just sitting on waiting, would help.

To be more clear, taking unemployment or not has nothing to do with whether or not you get past wages. It is how you act, if or when another company takes over the refuse of Nova, that could determine if you get your wages.

Don't and never have worked for NOVA. But I obviously understand a bit more about finance than you.

When mentioning 'AEON' I don't mean the eikaiwa, I mean the super-huge retail corporation which runs shopping malls all over Japan and also has it's own credit service, and even opened a BANK! as of today. There is probably a NOVA branch in everyone of these malls right now.

NOVA is not 'finished, period,' you fool, they are in court-protected bankruptcy. That means they DO NOT have to pay back ANY debts at the moment! A few landlords may have moved quickly to take down the signs, but obviously most are still up (I still see them everywhere). The office space in the AEON owned malls definitely has not been cleared yet.

Did you not read my post? 43 billion yen in debt is quite manageable for a corporation the size of AEON. And as the students who attend NOVA at an AEON mall are very likely to do their shopping there, it makes abundant sense that AEON might partner-up with NOVA. Also paying back wages and getting started on returning student refunds would be no problem for a company with the deep pockets (not to mention credit rating) of AEON. Talk was that there was already a plan in the works for a partnership here, but it didn't go through because Sahashi refused to step down. Well, so much for that roadblock...

As to staff, the longer it takes the more staff will move on with their lives. But if a deal were announced this week I'll bet 80% of the Japanese staff would come back to work, and probably 50% of the foreign staff. Since downsizing is inevitable anyway, they could start scheduling classes almost immediately. Even if not that many come back, new office staff can be hired within days, and eikaiwa teachers, well, they're a dime a dozen.

Your problem is you think like an emotional 12 year old, not like financiers and business people. There is a financial opportunity here for the right company. I still say a deal is more likely than not.

Just be aware that living/legal standards, wages etc are a lot lower than in Japan.

For those NOVA teachers who couldn't buy a ticket home after working there, just remember that you certainly won't be able to buy one after working in China and getting paid in Chinese Yuan.

Personally while I was working in Japan and Taiwan I always had either a return ticket or enough money aside for an airfare. I was around when a huge Japanese chain went bust in 1994..that was an object lesson in how quickly things can turn to custard...several thousand Eikaiwa teachers out of work just when I was looking to leave NOVA.

Some sort of contingency plan is even more necessary when your visa is tied to a specific job.

REGARDING UI APPLICATION WITHOUT BEING PAID TWICE, the General Union talked about this point in Monday's meeting in Osaka. It made clear that at the moment it is possible to apply for UI without waiting to be paid (or not being paid at all) late twice. This is because NOVA is not operating as usual but it is now in the hand of the trustees. They advised also to clearly state the reasons of you leaving the company (stress due to the situation, lack of living expenses etc ...).

Out of the four possible sponsors three have already said no (with Aeon claiming suprise at even being considered) which leaves only Yahoo

If you are not planning to remain in Japan and work the below advice from a ex-trainer (another post) is fine. Apply for any other travel insurance package, just remember to read the fine print.

If you are intending to stay here and work you can apply for Kokumin Kenko Hoken. This is basically government health insurance for self employed (contractors) and such. This gets you onto the official Japanese health insurance where you are covered for everything and only pay 30% no matter the cost. When you are on this you may be covered by your city government for total payment of extensive medical bills when hospitalised. (every city has different policies with this but I know personally that this is the case with Osaka City)

The cost of Kokumin Kenko Hoken depends on your income but the maximum is around ¥44,000 per month (but you need a really good income for that). Also when you apply for this, if you weren't on Shakai Hoken previously, you need to backpay for a maximum of the last 2 years.(if you've been here for 1.5 years you will backpay for 0.5 years, if you've been here for 10 years you only backpay for 2 years) If you are still in your first year you shouldn't pay anything.(first year health insurance is free for all employees in Japan as it is based on your previous year's income - side bar: meaning that it wouldn't have cost you or NOVA anything for your first year for Kokumin Kenko Hoken or Shakai Hoken)

With the current situation, if you have been here longer than 1 year, I would go down to your Ward office and apply for Kokumin Kenko Hoken and tell the insurance staff there that NOVA had been delaying your entry into Shakai Hoken and any backpayments will have to be refered to them (NOVA). This may be a great time, with all the comfusion, to get onto Kokumin Kenko Hoken and not be required to backpay.

Also please remember everyone, if you are on a sponsored visa, intending to live and work in Japan for more than a year it is basically illegal(not exactly though) to use travel insurance for your medical needs. One last thing, as I guess you may be required to do your own Japanese tax return for this year (due in March), what ever you pay into Kokumin Kenko Hoken and any other Japanese insurance is tax deductible but travel insurance alone is not.

Just had a thought, since you are all still "employed" by NOVA send a request form to personal to enroll you in Shakai Hoken. Then you can truly say to the Ward Office staff that NOVA has delayed your enrollment into Shakai Hoken.

I was just talking with my wife about this and she informed me that in special circumstances you can be given a discount on the monthly premium cost for Kokumin Kenko Hoken. I believe you all come under that category at the moment.

Just another note, once you're on Kokumin Kenko Hoken you can continue using it if the new business or company you start working for doesn't provide Shakai Hoken (some small companies are not require to enroll you in this). If your new employer does enroll you into Shakai Hoken it's an easy switch from Kokumin Kenko Hoken with no penalties.

what if you resigned and you dont live in Japan anymore?
Is there ANY chance for people like me who didnt get paid like my fellow nova teachers/staff...to get paid?
I had JMA(interglobal) so i was never on shakai hoken...what are my chances of getting any more back....(i dont live here anymore)

as far as i know, you should be entitled to 80 percent of your last pay as well..you should contact the GU and let them know where you are so that when the receivers start the process, they can find you to pay you (since you dont be in japan no more)

A school has three assets: physical plant (building), faculty & staff, and reputation. NOVA rents (rented), the faculty is buying plane tickets & the Japanese staff are looking for other work, and NOVA's reputation... Perhaps the NOVA name is worth something, people know it is/was an English language school. They will know that Sahashi et al. are gone, and they might trust the new management. But how much will someone pay for the name? If Aeon wants language schools in its stores, it can start them from scratch, better than buying the NOVA name and all the baggage that comes with it. How much is a name worth? Ask General Motors about Oldsmobile. Ask BMW about Rover...

I'm looking at this dispassionately from the other side of the Pacific with a relative teaching (was teaching) at NOVA. She's packing up and shipping her personal effects home. Her plane ticket is bought. She's by far not the only one--or else why would Qantas be offering discount tickets home.

The Japanese government is deliberately delaying paying unemployment benefits to foreigners by two methods. Firstly they have control of Ryshoku-hyo issue from Nova, and emloyees are being told that issue of these could take over two weeks. Secondly the Government are telling ex- Nova employees that the processing of UI could take well over a month. So the total time to receive UI could well be approaching 2 months. This would mean that employees will be without money for nearly four months. Are these the actions of a Government that cares about its foreign workers ? I think these are the actions of a Government that will not shoulder the responsibility for a situation that they have in part created. The Japanese Government is cynically delaying helping foreign teachers in the hope that they go back to their home countries.
