The Struggle for Unpaid Wages Continues

Remember when the Osaka Labor Bureau sought to have Sahashi charged with non-payment of wages earlier this year? Prosecutors shot that idea down because they couldn't determine if the non-payment was deliberate or due to the company's poor financial state.

It looked as if the case was over and Sahashi had dodged a bullet, but two former instructors have filed a petition with the Osaka District Public Prosectuor's Office to re-examine their decision.

The instructors say that the non-payment of wages was deliberate, arguing that Sahashi used the money collected in prepaid lesson fees for personal gain, which put the company in jeopardy. One the instructors who filed the petition, Robert Collins, says that he has struggled to pay the rent and education costs for his children. He also added that Sahashi said that he would pay the wages but has never made good on his promise, and that the prosecutors have a legal responsibility to pursue the matter.

経営破綻（はたん）した英会話学校「ＮＯＶＡ」（大阪市）が講師ら４００人に賃金１億円余りを支払わなかったとされる労働基準法違反容疑について、大阪地検が７月に元社長の猿橋望被告（５７）＝業務上横領の罪で起訴＝と法人としての同社を不起訴（嫌疑不十分）としたのは不当だとして、元外国人講師２人が２３日、大阪第二検察審査会に審査を申し立てた。

申立書は「受講者に多額の受講料を前払いさせる商法で経営を悪化させ、自らは不当に高い報酬を得ながら賃金を故意に支払わなかった」としている。申立人の一人で神戸市に住む米国人ブルース・コリンズさん（５０）は「家賃や子どもの教育費などで大変な苦労をした。元社長は『賃金を払う』と言いながら一切実行しておらず、刑事責任を問われるべきだ」と話した。

Hell, Ive heard of former Kyushu instructors who have yet to be paid their back wages from the government!! I think because they were left completely out of the information circle or something and had no idea as to what was going on! Wow is all I gotta say... not to mention its 2 days away from being the 1 year anniversary of the official collapse - another WOW!

Ok but what about all thise instructors that had money stolen from them. Saruhashi directly told the employees not to pay the rent for the instructors even though it was deducted from their cheques. That is called theft and might be easy to litigate than the salaries.

I'm one of them!

I'm one of the people who hasn't gotten paid yet. It's not like I've had my head in the sand or anything. I think they're just (bleep)ing me in the (bleep) with a barbed wire is all! First I sent my paperwork in in February. In July, I still hadn't heard anything. I contacted them and they said I must have done it wrong. Do it again! I did. I didn't hear anything for another month or so. I contacted them again. They said, we didn't get your bank info. This time I had copies of every single thing I sent and I KNOW the bank info was in there. What kind of dolt wouldn't send that part? So I sent it AGAIN! Then they said my bank wasn't a global bank. WTF?! I live in China and my salary is deposited into my American account and it has been since I started my job ALMOST A YEAR AGO!!! I asked that they simply send me a paper check. I got an email saying they'd deposit into my account (I guess they worked out the non-global issue...hahaha) by the end of this month. Well...TODAY IS THE END OF THIS MONTH! Does anyone wanna guess how much of a deposit I've seen added from NOVA? I've gotten f%*k all added to my account! That's how much!

Unpaid wages

Hello,

I am working as a teacher in Japan and last year one of the companies I was working for said they were 'having financial difficulties' and laid off all teachers. They owe me 2 months wages. Does anyone know who I can contact to try to get the money or a reputive lawyer, legal aid etc? I am not a member of a union. The company is still existing in some kind of working capacity but they do not give me any direct answers. The company is a small agency that hired teachers and sent them out to schools. I would appreciate any informed information. Thank you.

For crying out loud, the firt thing you should do, is joing the Union !! And guess what, there will be no Nova "excutives" that will harrass you on line for doing so, because they all lost their jobs ! Ask the Union for advice, and go from there.

I've heard INTERAC are up against the ropes and going to the wall. I am guessing the man or woman who posted that all too familiar story is working for them. You all thought the bosses of the old and the new Nova are charlatans. You should try interac. Tney are disgusting.

Blind Faith in Bosses is FOOLISH !

Having witnessed what Nova got away with, and did to people, and having heard what fun and games the new kid on the block is up to, ONLY AN IDIOT would work for eikaiwa unrepresented. Feel safer. Feel more secure. Consider joining the Union as a better alternative to placing blind trust in people like Saruhashi.
