Sahashi Sued for 16 Million Yen

A class action lawsuit has been filed against NOVA. This time, 24 former students are suing Sahashi, five of his directors, and accounting firm KPMG AZSA & Co. for ¥16 million.

The group says they want the truth and those responsible to be held accountable, citing that about ¥56 billion yen was never returned to NOVA'S 300,000 students.

The group of 24 is made up of former students from the Kansai, Shikoku, and Kyushu regions who signed contracts between 2002 and 2007 at 25 schools, among them the Umeda honko (Osaka), Ikebukuro honko (Tokyo), Tarumi branch (Kobe), and Shijo dera-cho branch (Kyoto). The group is demanding compensation ranging from ¥350,000 to ¥1,290,000 per person to reclaim tuition fees and the cost of equipment for ocha no ryuugaku lessons.

They charge that:

  • Sahashi and his directors engaged in a reckless expansion of the company by heavily spending on advertising that saw the number of schools grow to 994, and that they misappropriated the lesson fees it collected up front.
  • Sahashi and his directors were negligent in their duties to avoid a situation where the company could not provide enough teachers and was unable to refund money when contracts were canceled.
  • Five directors and 2 accounting firms participated in the bankruptcy of the company by allowing NOVA to continue to use illicit accounting practices where they inflated profits by recording 45% of advanced tuition for long-term contracts as part of its sales.

Comment: As you may know,this lawsuit is in addition to Sahashi already being indicted for embezzlement.

元受講生側は、猿橋元社長ら旧経営陣について「81年の開校以来、広告宣伝費に多額の資金を投じ、教室を最大994まで増やして無謀な経営拡大路線をとり、前払い受講料を野放図に流出させた」と主張。「必要な講師数が確保できず、解約時の返金に応じられない事態を回避すべき義務を怠った」と訴えている。

また、1~3年の長期契約を結ばせて集めた前払い受講料の45%を毎年の売り上げに計上したことを「利益水増しの粉飾決算」とし、当時の監査役5人と監査法人2社について「違法な会計処理を見過ごし、破綻必至の拡大路線に加担した」と主張している。

I think that the ex_employies of Nova should sue for the 20% of the wages that were never received. For a lot of those that kept going until the bitter end some resolve is needed. The new nova is just a shitty ,smelling , shell of a company.
G-comunications... Melthing(?) (what the fudge) is just a stupid company that will not last because they have no idea how to manage or run a company. Perhaps the company made it a year or so ago, but to be honest they have no idea how to do things. Again... melthing... wow that is a cool word!

How about a little bit of common sense here?! Many of the students were foolish, but I can understand their situation more because many were locked in long-term contracts they signed well before Nova got really bad.

The teachers who hung on at Nova, especially those who did so after it obviously had failed, were total fools. They should be more than grateful they got 80% for their stupidity.

stayed, to the bitter end, and witnessed the grief, and the carnage, first hand, I feel compelled to say... You are absolutely right. Of course, their are often mitigating circumstances, but in the case of me, and my coworkers, it was for a variety of reasons that we didn't get out ... laziness, stupidity, being incredibly gullible, and believing the "Everything's gonna be hunkydory" story, that Sahahahahahashi and the AAM spun us, or a combination of these things. I say this, earnestly, not jokingly, or sarcastically, we behaved like a pretty sorry arsed bunch. A few of us compounded our folly by signing up with G-Com, too.

I would add that I and a few people I know stayed because we knew we would get 80% eventually, and that was better then getting nothing for staying at home. I think it's a mistake to label all those who stayed as lazy, stupid or Nova diehards. People made their choices for their own reasons, and in their own self interest, as are some of the g-scum stayers.

Good for the students. I think they have a better chance of a successful lawsuit than the teachers or employees do.

When, or should I say "If", this lawsuit actually sees the light of day in court, do we honestly think this will hurt Sahashi? Civil suits are usually used to get what was denied in a criminal suit, or to add insult to injury. They also usually involve huge sums of money. 6 million yen is not that much considering the number of people he screwed, and 6 million yen will hardly put a dent in his tax haven, protected wallet. This will merely be a nuisance to him, but it makes for great watercooler talk.

Regardless of how much they could get away with, I don't there is so much there to get. Lets say they won really big. Who would pay the settlement? Most of the money has been stolen, spent etc. Even if they take all Saru stole (that he has not spent yet), it would be a drop in the bucket compared to how much was lost by students.

I have a simple question. Why do you call those that worked for their money fools? Regardless of why you came to Japan or worked for Nova, you are entitled to be paid for what you did. Hey, been around a while, seen a lot of stuff, seen people come and go, seen companies come and go. Not nice callin people fools though. A lot of old timers got caught too, and they were in the know.

We all knew Sarhashi was a greedy man, but very few of us realized he was also a mentally ill nutcase.

That third point, 'the use of illicit accounting practises' came up last year because it was one of the main reasons that the trustees initially underestimated NOVA'S debt and it affected negotiations with potential sponsors (and look who we ended up with).

I was surprised that this point wasn't mentioned as part of the indictments against Saruhashi this year, and I'm equally surprised now. If the students can take legal action against Saruhashi and accounting firms for illicit accounting practises, then why haven't the public prosecuters done the same? It seems far more clear cut crime than the above-mentioned embezzellment of the employees support fund.

Simple Answer

Corruption - Saurhashi had LDP mates who grew fat on the Nova cow back in the good old days (how do you think they got away with so much law breaking, but no action taken, to begin with - it was only when the Japanese themselves cried foul, that the government decided to step in - to avoid the whistle blow of the century, they want to go soft touch on the guy, as much as possible, while appearing to be the firm hand that put a stop to all the nonsense)

It boils down to this. There was a lot of buzz about Nova not making it. I knew this and I had never even worked for them.

Now, there are obviously a lot of factors here, but I just think people should show some responsibility and not expect to be bailed out every time they are foolish. There was plenty of info out there. People were still going to work even after Nova could not make the payroll!!!!! It was pure insanity/stupidity to think they could have come back at that stage with the company run into the ground and with all the bad press. Anyone with any options and sense should have jumped ship by then.

A year on

G.com is still going it appears. Not much word on opening schools, but I've heard two in Tokyo were moved/combined. The shortage of teachers is still there, after the massive culls in Dec, Jan, and Mar. Now anyone who has spent significant time in English speaking countries can get a job it seems. G.com hires uni students without degrees, at least two Filipinos who were questionably "native" speakers, and possibly one guy who almost finished high school. Mostly rumors, but I trust the sources. Students up to 5/class and to get around paying the instructors for the increased workload g.com issues \200 coupons for teaching a class of 5, good only at g.com restaurants only on weekdays- only if all 5 students show. Most teachers don't want or use the coupons. I've got about ni-man in those worthless coupons. Students still complain about booking lessons, 5 student classes, and lack of voice periods. One teacher somewhere suggested a wine tasting voice and that got turned into wine lessons.

"If you don't buy more tickets, we'll go out of business, and then you won't be able to study. Please buy 300 tickets".

I'm just wondering who in the world is paying for those g.comm classes if things are still so messed up? It is not as if there aren't plenty of schools to choose from. Are they getting new students or it is basically just the old Nova loyalists????

About those wine lessons, they are the last lesson of every month and are mandatory. I've heard of teachers who object to serving alcohol to students being told to "just do it". The wine is of cheap quality and served in little paper cups. Some schools teach full schedules (32 to 36 students/day) while other schools teach mostly lucky man-to-mans. There is NO training whatsoever. New contracts are mailed to teachers with no evaluations being done, and from what we hear there will be no raises in the future, ever. I know a teacher in Tokyo who asked for national health and pension and g.com took over six months to give an answer- not surprisingly the response was no. Schedules aren't at all balanced. I've taught days with 35 to 40 students and part-timers got 5 students. It's kind of sad, the teachers have more or less stopped complaining about everything. Nobody seems to care anymore, we just go through the motions and collect the paycheques.

Why don't we join them?

Why don't we - former teachers under Srauhashi - sue him also, for the same reasons? Also, there are others reasons to file suit as well:

- Not being forthcoming to the employees about the state of the company's finances, including continuing to recruit teachers from overseas whom he knew couldn't be paid. Pain and suffering, anyone?

- Deducting rent and insurance from paycheques WITHOUT paying respective creditors - stealing - and not telling teachers immediately that their rent hadn't been payed.

I might be foggy on some details, but I'd join a class action suit if I could be convinced it was worth it.

Stick it in, and twist it! Does anybody else have any thoughts on that idea?

Some of us have timetables that make changing careers a little difficult and others just like collecting the easy paycheck until something better comes along. Everyone has different reasons for anything they do. I can only speak for myself, and while I'd rather not go into too many details, I have always enjoyed teaching. I think all eikaiwas are more or less the same, so NOVA is no different, and I gave up a university job because this gig is more flexible. Don't berate or belittle people for making the choices they do, just make sure you are looking out for yourself and you'll be fine.

Mark may have his own reasons for staying at NOVA. I did 3 years in a crappy private school in Korea before coming to the Kingdom. Then I used the "ESL" experience and a TOFEL I got online to come here and make really good money. There may be a motive to staying.

I'm sorry, it seems you may have misunderstood my intent. I wasn't posting here to complain. Someone asked what conditions were like and I gave examples of some of the things I've heard. Not everything is as bad as you read (or as bad as some of you wish it would be). At my branch we have 3 full timers and one part timer, none of us are titled instructors and we never see management. We teach what we want and don't really have that many complaints. I apologize if you think I was whinging, I only meant to convey information. Why people who have moved on to those better jobs are still so bitter is a mystery to me, but I'm not sweating it.

Another thing though, in addition to the crap conditions many put up with at GCom, as I alluded to before is the increasingly uncompetitive salary (when you're actually lucky enough to be paid in full).

Te fact that I'd leave Japan, before I'd work for GCom isn't bitterness, it's pragmatism, and self respect, but you are right, I don't know your situation. You could be an investigative journalist, masochist, or sucker, or all three, for all I know, OR you could be working for GCom for some hitherto unknown benefit. Sorry for my assumptions.

I cant help to compare Nova

I cant help to compare Nova to Japan during WWII (I know off topic). They were trying to take over the world/Japan. Japan going into Korea, China, Phillipenes, Thailand, Burma and the Pacific Ocean. I am in Thailand now seeing the history of the river Kwai. They were trying to conquer the world working their way into India. Nova was doing the same thing, overexpanding thinking they were going to dominate Japan while they were just working their way to their demise. Funny shit. All of the commanders were just doing what they were told, just like the the upper management/AT's at Nova.

Anyway, people working for Nova were just drones. Following orders and following through. Couldnt help but see the comparison.
