Nova Equity Warrants Purchased

The JASDAQ stock exchange [PDF] has reported that Nova's equity warrants have been executed purchased.

According to the announcement, 400 equity warrants were executed purchased. (200 by Rich Peninsula Trading Limited and 200 by Tower Sky Profits Limited) for a total price of 70 million yen.

It looks like Sahashi gets his cash injection, so presumably teachers stand to finally get paid has all but signed Nova's death warrant. Sahashi gets a measly 70 million yen in the process but teachers and staff are still left to wonder about their pay. Rich Peninsula Trading and Tower Sky Profits are now poised to take over Nova should they decide to exercise their equity warrants. By all accounts, they aren't interested in saving Nova, but pumping and dumping it.

Just curious, how many of you teachers will return to work if you get paid? I hope nobody. In a way i am kind of worried about a paycheque coming. Obviously i want everyone to get the money that is owed but i just fear that maybe enough teachers will go back to keep things going for another month, giving the monkey an excuse to delay that bankruptcy announcement just a little longer. I dont want to work for this company anymore but if i officially quit i cant get u.i for 3 months. my visa will be up before then. The sooner the end comes the better. Just my opinion.

i agree but...

don't bet on that unemployment insurance. the company has to declare, or be forced to declare, bankruptcy before you can even think of collecting and then it will still be a hassle. at this point, the only hope is the Labor Standards Office does something, but the chances of that happening are as slim as Sahashi stepping down. i think everyone needs to face the fact that this is a capitalist country that thrives on big business and governments don't step in until the last minute (not looking for a societal or geo-political debate please, just stating what is fact).

however, i do urge people to continue striking even if we get paid because it will most likely be our last paycheck. use your paid holidays if you really want to gamble on this company and wait to see if you get a check on the 15th on November. i bet it will be the same song and game.

Need advice on hard decision to make

I applied for a part-time job and got accepted. It starts next week if I accept.

I am officially on paid holiday at Nova, and know the end is coming. What I want to know is: If I work this part-time job, does it disquailfy me for unemployment insurance eligibility? The part-time job is only two lessons a week, clearly not better than what unemployment insurance would get me. I need to let the part-time job company know by tomorrow. Help!

Not 100% sure but I think you can work up to 11 hours a week and still collect Unemployment, check back through some of the previous threads, all the info is there.

I just want to encourage all Nova teachers and to go and get their own advice from Hellowork and the Labour Standards Office. I know a lot of the information posted here is accurate and most people are trying to help but there also seems to be a lot of Chinese whispers going on too. I have gone to both Hellowork and the Labour Standards Office and now I have a good idea about what's going to happen regarding salaries when the inevitable bankruptcy occurs and the situation regarding unemplyoment insurance.

Nova will be classified as a large company and the government's salary support scheme only applies to small and medium companies that go bankrupt so there will be no help there. Teachers and staff will be in the position of creditors and final salary payment will be dependent on the bankruptcy and liquidation process.

As for eligibility for unemployment insurance, all full time teachers (A34 and over) who have worked for more than 6 months and worked at least 11 days per month, will be eligible for some unemployment insurance payment. The size of the monthly payment will depend on the circumstances of each individual, contract type, years of service, etc, Furthermore, the failure to pay salaries on time for the last 2 months is sufficient grounds to resign from Nova and obtain immediate unemplyoment insurance, you will not be required to wait three months to become eligible. It's not necessary to wait for bankruptcy to be free of Nova and be eligible for unemployment insurance. The only thing to keep in mind is if Nova goes bankrupt and you are currently employed by them, they will also be liable to pay you an extra month's salary for breaching the employment contract which requires 30 days notice before contract termination, of course, whether the funds will be available for this payment is probably unlikely.

However, don't take my word for all of this information. Go and get the information for yourself. If you can't speak Japanese don't worry because most offices will have an English speaker present at least once or twice a week or get a Japanese friend to go with you.
It's definitely worth your time and effort so you can know where you stand and what your next move should be. Good Luck!

NOT true, ACCORDING TO the "Osaka Prefectural Labour Bureau". According to a General Union official who inquired about this topic from an official there this is the case:

Classifications are done on a capital basis, not on the basis of employee number or geography.

For small and medium sized firms an official of the Labor Standards Council (presumably the top dog) can give the green light for the Wage Loss Compensation System to kick in, after determining through an inspection process, that the firm is no longer a going concern. No bankruptcy proceedings involving the courts needs to take place. It is purely(?) an administrative action. So that’s how some of the employees from the smaller schools did eventually get their 80%.

NOVA is classified as a large company. This class can yield an 80% payout as in the case of its smaller brethren, and the functioning of the Wage Loss Compensation System is exactly the same… BUT proper, formal bankruptcy procedures MUST be gone through FIRST.

All employees have been paying into the government insurance fund. Take a look on any of your payslips. In the "deductions" section, top row, far right box where it says "E.Ins".

So if Nova goes belly up and you've been there for over six months, then you're safe.

What about if you resigned from Nova and you are not living in Japan.I moved back to the UK. Can i still claim if Nova goes under? I am still waiting to get paid from Nova for SEPT for my vacation pay..a full month. What can I do?

Unemployment is not eligible for people living outside of Japan. You can try to get your unpaid wages, but it's a somewhat complicated and lengthy procedure.

Part-time teachers are screwed. Since they don't pay into the unemployment insurance, they are obviously not eligible for it.

Full-time employees have to wait until the company falls before they can receive immediate benefits.

Get your facts straight. This is totally incorrect. Posting garbage like this only makes people's lives more difficult.

The size of the company only matters in one situation. That is smaller companies are covered if they are bankrupt in reality but do not legally declare bankryuptcy. Any company is covered as long as they legally declare bankruptcy. Hello Work do not make these decisions. If they tell you otherwise it is because they don't know what they are talking about. I had to correct them on several points when I went in the other day and after clarifying them with their managers agreed that they were wrong.

CLAIMING Unemployment Insurance

Um. Not sure where you get your facts, but I went to the Labour Standards office/bureau, and NOVA doesn't have to go bankrupt for you to collect UI. All they have to do is violate the law - eg. not paying you on time - twice in the same pay period (ie. delaying your salaray twice) and you have - what is considered in the eyes of the law - Just Cause to resign, request your Rishokuhyo and then begin the process for getting your UI once you've received it.

Just make sure you clearly state on your resignation that that is why you resigned and keep a master copy of it.

And make sure that you verify your address, they will send the Rishokuhyo to whatever your address was as of Jan. 1st, 2007, EVEN if you filled out a personal address update in the event that you have since moved. You need to email foreign_personnel@nova.ne.jp and specifically state the address you would like your rishokuhyo to be sent.

Working Part Time and Claiming UI

You can work up to 20hrs/week and make 2 bucks or a million, doesn't matter, you just can't work more than 20hrs/wk in order to be eligible for UI. I have had to lengthy interviews with the Labour Standards Bureau with an amazing translator present. So, part-time away!
