The Japanese press has caught whiff of what instructors still hanging on with neo-Nova already know: many are losing their jobs through some creative firing. UPDATED
Here's a translation of an article in the Asahi Shimbun:
Nagoya-based g.education, which took over operations of failed English language school Nova, has effectively "fired" some its foreign instructors by not renewing some their contracts despite promises last November that it would re-hire them. G.education says it looked at the instructors who had contracts carried over from Nova and did not renew those it deemed had poor work attitudes. The General Union said it will file a complaint with the Osaka Labour Bureau on Friday stating that it is an illegal termination since g.education failed to sufficiently explain the contract period when instructors were re-hired.
According to g.education, it has rehired approximately 200 Japanese staff and 1,200 foreign instructors since November and carried over the employment contracts instructors already had with Nova. Instructors who were near the end of their contracts finished in December and January.
When those contracts were up, g.education decided not to renew the contracts of those instructors who were "away a lot" or had "a lot of student complaints." G.education says this amounts to about 30% of instructors but did not give a concrete number.
Since January, the General Union has offered advice to about 200 instructors who were refused contract renewals. Says Katsuji Yamahara, head of the General Union, "G.education has not given instructors a clear explanation about continuing to work after the Nova contract period. The number of instructors refused contract renewals is higher than 30% and there are also some who have been let go even though their contracts have yet to expire."

Ex-NOVA teachers file complaint about getting laid off by new owners
About 20 foreign language teachers formerly employed by NOVA Corp. filed a complaint with a labor standards inspection office here on Friday, claiming that they were illegally fired by the companies that took over the failed language school chain.
"Unfair dismissal!" chanted the former NOVA teachers as they joined a prep rally held by the General Union in front of the Osaka Chuo Labor Standards Inspection Office in Osaka's Chuo-ku on Friday before they filed the complaint with the office.
Nagoya-based G.communication Group bought out NOVA after it filed for protection from creditors in October last year, leaving NOVA under bankruptcy proceedings.
However, G.communication Group fired about 800 former NOVA teachers at the end of December, overturning an earlier agreement in November that the company would in principle hire all the former NOVA teachers who wanted to work for the new employer, according to the General Union.
Furthermore, the company refused to renew employment contracts for about 200 other teachers, leaving more than 1,000 teachers unemployed. The dismissed teachers claim that the company violated the Labor Standards Law.
"The company violated the law in that it did not sign employment contracts with the teachers when they started working in November. The company's dismissal procedures also breach the law in that it notified the teachers of their dismissal via e-mail and without notice," said a representative of the General Union.
However, G.communication Group says they had good reasons to fire them.
"In the first place, we did not promise to hire all the teachers, but only as many as possible. We have reasons for the dismissal as some teachers refused to be transferred to other locations (in Japan)," said a representative of the company.

not renewing contracts
the justification for the refusal to renew contracts is deceitful. it's very hard to detect any principled basis on which they have made their decisions. i cannot know what happens in other schools ofcourse,and maybe some people were inexcusably 'sick', some people, but that wasn't the rational they used for sacking people. its the easiest cop-out, set up a nonexisting strawman and blame everything on him. i can't see any logic, only number worshipping morons who insist on eliminating a fixed number from each area. it is a numbers' game folks, make no mistake. i work in a thriving school which needs all the teachers it has, and will soon need more, yet i was told i might be able to continue working if i were willing to move to another part of the country where they were lower on teachers, just to balance things up. yet i'm needed precisely where i am, looked at from their 40-1 principle. g-comm are just amateur jugglers trying to balance things up, not caring to realize the balls they are clumbsily juggling are people's lives.
When the Labor Standards
When the Labor Standards Bureau investigates unlawful terminations, they will ask the employer to submit written warnings (signed by the employee), performance review documentation (again, signed by the employee), etc. to substantiate their claims that an employee was not performing to the company's expectations.
Keep that in mind. If anyone who was unlawfully terminated by G Com wishes to challenge their termination, then G Com will have to submit proof that one has violated company rules or that their performance was sub-par.
But then again, given the dodgy nature of G Com, why would anyone fight to stay with this company?

Unlawful Terminations?!
I don' see how failing to renew a contract is an unlawful termination. It is simply failing to renew a contract. There doesn't even need to be a reason given!
BUT...if there was a reason to be given, wouldn't it be refreshing to hear the official response be, "Well, if we renew a contract a teacher expects an increase in salary. Many of these teachers (Nova Lifers) had already been near the top of the pay scale, so our financial consultants suggested we just get a new crop of youngsters to work for peanuts."

Unlawful termination
The question here is not whether or not the non-renewal of a contract is unlawful, of course is not. I am one of the fired instructors who will file a complaint with the Labour Standard Office in about an hours from now. We'll file a complaint not because G-shit hasn't renewed our old nova contract (that was legally terminate at the end of November) but because they never gave us one in the first place. We have been fired by g-shit, this is our point, and we have been fired in an unlawful manner. No reason and written notice 30 days notice. In addition, g-shit had a clear agreement with the court to guarantee everyone a job. They were given the green light by the court because on this point.
I also think that g-shit are a bunch of idiots (intelligent people would have gone to a consulting agency to get a feasibility study for this operation) and I never trusted them from the beginning, in particular when I read that its CEO was a former juku teacher. The same old story of amatorial Japan. Anyway, I don't wanna work for them, but I just want to get the month salary I believe they own me, after that they can all go to fuck themselves.
Non-renewal of contracts
It's not just those whose contract's are expiring who are being let go. From what I gather EVERYONE who is on standby come March 31st will be let go, regardless of contract expiration date.
Though, as the comment above points out, as old Nova contracts were terminated when they officially went bankrupt, there really is no contract to expire.
And what will happen to their 40:1 ratio when there are no more teachers to bring back from standby after March 31st?

Yeah, from what I've been told, the ratio is currently 70:1 in parts of Tokyo, but it really seems like they aren't using their heads when they come up with these numbers. 100:1 doesn't seem surprising if you figure they want the business to fail before the 6 month mark. Will this company ever be able to hire any new instructors after all this?
The end of this crap
Regarding the above comment, NO, I think they won't be able to hire new instructors and they won't be able to find many new ones even if they want to. Lots of people want to leave now. Too many lies, too much mistreatment, too little respect and job security; basically they fucked the all thing up. G-spot reputation is compromised, and just wait for the bad publicity that the dispute with fired instructors and GU will generate (lots of media people this morning outside the Labour Standard Office, and it'll be on the news tonight). If you add to this mess this new ratio of 100:1, which inevitably means cancelled lessons in the future and students complaints, it's easy to see that this crap new-nova won't last too long.
A BETTER WAY
The sad thing is, as much as we loath the decietful conduct of the company we're now employed by, raising media and public awareness of problems now in the eikaiwa peak season will surely sink the ship with us on it again like it did last year. I wondered if the media weren't leaving them alone to give the business a chance at this important time. G.ilovesexploitinghaplessemployees have been so stupid... they only understand rationalisation - which stems from the fact that they got big by taking over other companies, not by creating or growing anything positive. They're experienced in exploiting hordes of casual/contractual japanese workers in juku and restaurant chains who probably don't offer much resistance to such a scary organisation ('cause they know what they're up against - dare I suggest Yakuza links?).
Everything that's happened was so predictable. I wish I was Inayoshi's advisor, i would've said DON'T promise to take everyone, and if the government-appointed trustees insisted on it I would have advised him to tell them to get fucked and forget about it.
But you know some are whispering that G.com went into it to earn a 'get out of jail (but not for free) card'. Remember the reports last year that the company was under investigation for some dodgy dealings? This could be their way of getting back into favour with the powers that be.
If Inayoshi hadn't promised to take everyone i think we would've accepted it, and they might've kept the best teachers, instead of losing those who had other options. They would've had appropriate numbers from the beginning making deception and devious methods of exclusion unnecessary, and if they needed more later they would've been able to bring others back.

Transfer Refusals- Another Deceitful Excuse
The only excuse they gave was that some teachers refused to be transferred. I know of about 4 teachers in the chugoku region who were offered transfers, and they were each given one or two days to start work in new locations like Nagoya and Aichi. If they didn't accept they were going to be put on standby and eventually cut. Surely if they haven't given reasonable notice they can't make that an excuse for dismissal.

When Gcom took over NOVA, they said in principal it would rehire anyone who wanted to be rehired. The rest of the text was similarly worded as I recall, words like try, hope & in principal were all over it. I thought with such wording there was no doubt that it was a shaky deal.
People who joined up with no back up plan, then just sat around while on standby believing everything was going swimmingly, or those that took option B to be honest deserve everything they got.
People seem to forget that Gcom is a business & is trying to make money. It didn't take over NOVA just from the goodness of their little hearts. Why would any business want to keep on undesirables? Maybe people who called in sick a lot had genuine reasons for not being able to make it into work like genuine sickness. But I don't want any sickly people working for my company. The lost man hours really adds up when you have a lot of useless bastards who stroll in late or not at all.
Sure it seems shitty but after all is said & done they are going to try their best to turn a profit. If that means cutting the slack then don't be slack! Too late? Too bad!

a) the trustees disclosed to the GU the details of g.crap agreement with the court, and g-crap actually said that they were going to re-hire all former nova instructors who wished to work for them.
b) it's true, g-crap is a business and like every business needs to make money, but instructors are being fired exclusively on the basis that their old nova contract expired or is about to. So, all this story about selecting instructors on the basis of their previous work performance is utterly bullshit. This was just a public excuse which is also damaging teachers who are now trying to find a new job, as potential employers may now think that you were let go because they were crap teachers. These motherfuckers behaviour is appalling and they deserve to be taken to court, they deserve all the bad publicity they are getting these days, they deserve to go bankrupt and they will. Because business does not always necessarily mean being deceitful and screw people over and over and over.

They have decided to break their promise (or obligation) to hire all instructors because they think it is the best possible business decision to make. I'm not saying I disagree with you fully but check your facts please. Especially after using ignorant language like "lazy bastards." I'm looking right at the papers they gave us to sign (both options A and B) in November and there is no might, maybe, try, nor hope written anywhere on it. In fact it uses the word "shall" all over it.
Here are some examples:
"You shall be hired as an employee.."
"You shall begin work on January 10, 2008" (for option B)
"Your monthly income SHALL correspond with your final monthly income at Nova Corporation"
Last time I checked, the word "Shall" meant a pretty strong assertion. Pretty close to a promise if you ask me and quite a bit different than, as you say, 'try' and 'hope.' I can easily see how many, especially the young kids coming over with little life/work experience, could easily be misled by these false promises.

If G-Comm were cutthroat and cunning, I would be inclined to agree with one of the above posters. The rub is that they have done nothing but bumble from that get go. The branch that I work at is losing money hand over fist in expensive overhead, but the numbers are coming in which would be great if there were sufficient staff numbers to handle the students...but there aren't. If a sick call could be covered so that there aren't dozens of students denied classes every weekend that would be great...but it's not the case. If G-Comm could replace the instructors that will be quitting in the next several months, students might renew past their discounted tickets...but G-Comm has no recruitment strategy and 'standbys' are gone. The students are already groaning... and this at a supposedly 'good' branch.

It didn't need to be this way. G-shit made all the wrong decisions a company can possibly make. They made the impossible promise about hiring everyone, they over-rated the nova's value and they planned this whole thing on the cheap. They probably thought they could make a lot of money pretty quickly and now they are trying to save the pennies. If they were a little bit intelligent and capable, instead of firing everyone indiscriminately and incurring in the wrath of unions and teachers (and very soon students too), they would have come up with some sort of more constructive solution. For instance, offering a severance package, the opportunity of part-time work etc ... I am sure that many people would have accepted a couple of months salaries to get out, and at end this would have been much cheaper. But, in order to come up with a proper plan a company needs proper MANAGERS, not fucking stubborn and arrogant ex-yuku teachers.

Anything goes, in the name of making money
You will always find a dickhead in Eikaiwa who (a) does not know how to teach, (b) has a primitive grasp of Japan and Japanese language, and (c) compensates for his/her extreme deficits by jumping on the “this is business” bandwagon (which is usually just an excuse to be a pompus, arrogant c%nt, in a pathetic attempt to disguise one's ignorance). Nova was chocker block full of them (from AT position and above), and they all ended up on the scrap heap, just like everyone else.
There are laws that govern business, but eikaiwa is famous for spitting in the face of those laws, and the main reason for that, is because the Japanese and their governing bodies don’t give a shit about what is essentially a gaigin issue, and the yakusa style business people that run eikaiwa don’t mind dicking people over, on mass. They have their own rules and laws - and fuck everyone and everything, as long as a very thin surface spray maintains an appearances of "professionalism".

However, not because eikaiwa is about making money, but, because, eikaiwa owners and managers are notoriously lawless, low life, who would sell their grandmothers, in the name of making money – hence the reality today.

could anyone please tell me what the union has made of all this? have they accused g-cumm of breaking the law, or do they believe teachers whose contracts have not been renewed have no legal recourse whatsoever. have they managed to win anything from g-cumm through their negotiations, and if so, has it been only for union members? has anybody actually found out what the legal position of dismissed teachers is, or is it the case again that everyone in the labour standards offices gives different answers to different people?

They gave students a 75% discount when even an idiot could understand that this was not economically feasible. What were they trying to achieve? I agree with you, maybe they were planning to get rid of many teachers from the start, but did they really need to do it in this self-damaging way?

But they weren't expecting to go 'full steam ahead' from the beginning. What were the numbers they said? 30 schools then 200, out of the original 600 plus.
However about half the original number of teachers asked for employment, so they were always going to be ridiculously overstaffed. You can't expect to do anything but lose tonnes of cash for at least the first few months in that situation, so they knew they had to exclude and shed teachers from the beginning.

I was put on standby and no one would tell me why. Three weeks later I was asked to transfer to the opposite side of Japan. I refused. Now I find out that the people there are being asked to transfer too! I got paid on the 15th and still they won't tell me why I'm on standby. I wonder why I haven't been released? Not that I'm complaining. If they want to pay me to sit at home fine!

Yes, I was there, on November 10, if I remember well. I remember the fucking idiot live from Tokyo (I don't remember if Inayoshi or Ono) promising jobs for everyone, and also mentioning that his two sons studied at nova and "loved teacher Bob". What a stupid comment to make, maybe he thought it was funny.
It's now pretty clear that they had no plan from the beginning, and no research was carried out to test the feasibility of this takeover. On December 14, during a meeting with the GU and the trustees, g-CON even said that they were worried about not having enough instructors for the business to work properly. A week later they were sending emails to B option instructors telling them that their services were no longer needed. What happened during that week? How could the situation be turned around so drastically?
Well, apparently someone more enlightened, in some place that counts (BANKS, the ones providing the cash), decided to take a look at g-CON handling of this operation. This someone probably asked himself the same question that a lot us asked at the time: how can you secure a job to everyone if you downsize the company from more than 600 branches to only 200? For sure it didn't like the answer, and decided to put some pressure on g-CON management to come up with something more realistic. And here we are.
But, another question, and I think a relevant one, still needs to be answered. How could the trustees and the judge accept and approved such a plan?

I was smart enough to quit early and now I'm raking the cash in at Shane. I've got great working conditions, a very understanding management group, career prospects, and the best students in the Tokyo area.
Life was looking pretty grim for me back in October, but now the sky is the limit! No thank you G Com. I made a pivotal decision in my life. When I go back to Canada and visit my friends, I'll be able to say "Life in Tokyo is good. Very good."

Don't forget that at the MMC there are also people from Italy, Spain, Germany, France and China. They all came back because they had no choice, job opportunities for these people are extremely limited compared to English native-speakers.
The real question is why would anyone whose English is his/her first language want to work for this scum. I still see quite a lot of fired English instructors fighting to get their jobs back, why? wouldn't be more constructive to devote one's energies to find a new and better job? Even if they got it back, how long would it last?
I was in a non-English team at the MMC and was fired at the end of January. I am looking for a new job and managed to get a few interviews, and still fight g-crap through the GU, not because I want my job back but because I want a month salary as compensation for being fired without notice. If I don't find another job, I am ready to go back to Europe, but as for g-crap, no thank you, NEVER AGAIN!!!!!!!

I was surprised too by how many of the long-termers at Nova have carried on working for G-com. I heard of some trainers who basically "sat tight" until they got their job back, and didn't seem to have any inclination at all to find another job.
I suppose they've built up a bigger salary over the years which they don't want to lose, especially if they're now settled in Japan and some of them with families, mortgages etc.
Plus a lot of them probably don't have any other skills, qualifications or experience they could use. Or if they do have those things and did manage to get another job, they'd have to work much harder than they would at Nova, and/or have a lower salary than they have now.
However, with all the BS that's going on with this new lot, it smacks of desperation to want to keep working for them.

Certainly there is not a problem with emailing documents in a business but payslips are confidential and shouldn't be emailed over the internet where anyone has access on it. Did they even ask us whether we wanted our information emailed?

Nova students to book lessons online
OK, something I heard today is that next week students should be able to book lessons online AND designate a teacher for the lesson.
Consequences? Many!
1. Popular teachers will be easily identifiable. Their schedules will be full. Unpopular instructors get light schedules, and probably no new contracts.
2. What will happen to shift swaps? Perhaps they will go the way of holiday requests, i.e. have to be applied for one month in advance.
3. A student who books lots of lessons in one day may have the same teacher for lots of lessons in the same day too.
4. What will happen to new instructors? Perhaps higher level students won't want an incompetent fresh instructor so these instructors will tend to have lower level students while veteran instructors get high level students.
5. Since students can book in at any time, will the staff be aware of changes to the schedule? Will instructors go into class expecting 2 students and be surprised that there are 4 students in the room? This would lead to students complaining that although they booked in to a lesson the instructor taught them the same lesson that they had recently.
6. Perhaps it will become harder for ATs to switch lessons to get free lessons because the students requested the AT as the instructor.
7. This depends on how the webpage works, but if there is a drop-down menu to select the teacher from, then the first instructor on the list might get selected often because students are too lazy to select another instructor.
Right now I can't find any webpage to confirm this new system, but hopefully it'll be publicized next week.

I'm sure most instructors are thinking of an exit strategy. I already have mine worked out. Instructors whose original Nova contracts expire from April onwards may be planning to just finish the contract and then move on to something else. Because of this I predict G Ed/Nova will be in trouble in the later half of this year.
Transfer or be fired
On the 20th I found an e-mail with a PDF attached, basically it gave me 3 days to "accept" an "offer" to transfer to a box in the sticks with no utilities connected, in the middle of winter, with a WHOLE fifty thousand yen to ease the pain. I had to reply by Saturday the 23rd. Unfortunately I wasnt able to reply via e-mail so I called them. They said a hard copy would be delivered that day, the day the reply was required. If I answered NO to the "offer" I will be "let go" from March 31st.
So far Im the only person I know who's received this around here, but I actually feel better now. There's light at the end of the tunnel. I consider my relationship with this.."company"..to be over as of yesterday. When they called me the next day and asked if I wanted to come in for ONE DAYS WORK...my girlfriend hit the roof. She called the Japanese area manager, but all she did was constantly say "What we are doing is not illegal." She wouldnt answer my girlfriends questions and instead kept asking for her name and what was our relationship.
For those who are going to say "You're still there?" don't bother please, we've heard it a thousand times. Yes that's right, some of us are/were still there. Mostly we7re not free 20 something singles who can just up stakes and blow. We have wives, children, houses, responsibilities. Maybe some of us started like you, drinking all night, showing up late, but we settled down. And despite what some people think, prior to last year Nova WAS a secure job. Unless you totally screwed up (I screwed up plenty the first 2 years), a new contract was virtually guaranteed.
For the those who arrived towards the end, you came to an almost entirely different job to the one we came to.
And no, we havent been sitting on our arses, praying to G Comm to save us. Everyone has been looking for another job. I applied for one recently...so did over 800 other people. We'll jump when we have somewhere to land, somewhere that will give us a chance to at least come CLOSE to getting enough money to support our families.

If your city has an International Center, they might have free English lessons, or you could exchange language with a foreigner for free.

Nova was a terrible company. Yeah maybe it gave you a steady paycheck, but it was miserable. You can find another job. Especially if you have been here for that long. Come on. Dont you have any connections? The only excuse you have for staying there is lethargy and comfort. You cant be bothered to search for another job, or follow through with it and so you just complain on here. I found another job easily, and it took that to make me realize just how horrible Nova was. You will be so much happier (even if your income is initially less - you can do it) when you leave, because you wont have to deal with this. You shouldnt have to deal with it. What continually disappoints me about this situation is the lack of brand-image management on g-comm's part and the seemingly willful blindness on the part of returning students to the working conditions of the teachers. I have not seen or heard of one teacher who was "happy" to be working. Same problems as before are going to occur. Too many students, not enough teachers: can't reserve lessons. Low morale: call in sick on a "bad bento." Same shit. Sorry. I was at Nova for a long time (too fucking long, but that was the way my life was going. Now, I'm on standby, taking their money, taking their students, setting up my own business. Can't say it's paradise, but I can't imagine turning up for work again in Nova, looking one beaming, happy student in the eye, and not laughing in disappointment. Fortunately, I was never pro-Nova.
