So far, it appears that g.communication has botched the rebirth of Nova. No matter how much lipstick they try and put on it, neo-Nova still looks like a pig. I did a little digging in the forums and came up with a few choice nuggets from ex_sensei that illustrate how bad things are going for g.com. The picture he paints makes the old Nova look good by comparison.

NOTICE OF WORKING CONDITIONS

Everyone who is currently working and their contracts aren't up for renewal for the foreseeable future, should get a new NOTICE OF WORKING CONDITIONS forms which they must sign and fax back to Foreign Personnel. However, FP has no clue as to who is working at the branches so they haven't made one up for everybody currently working. This is not FP's fault but rather GCOM's fault for not keeping them in the loop.

If you're working for GCOM and haven't signed a new contract, please ask your branch manager to see if she's received the NOTICE OF WORKING CONDITIONS. She has probably already received it via a PDF file sent to the branch's e-mail account (as each branch now has an e-mail account). Ask your manager to search for it in the branch's e-mail inbox and print it out for you to sign. The forms must be signed. If you don't sign them, then technically you can be put in the bad books and be deemed "uncooperative" and let go!

March 8

BRANCH VISITS

They've already begun and they'll be conducted by the members of the Human Resource Enhancement (sic) division headed by Mr. Yamaya (the chap who's going round and retraining instructors how to 'smile' and be 'better people') with help from ex-GMs Kisa Leota-lu and Jack Aranda. Yamaya is a big twit, but Jack's alright and Kisa cares to some extent.

They'll be doing inspections of cleanliness, evaluating instructors (actually watch lessons), interview J-staff, talk to instructors, evaluate morale and make sure all materials are up to date (they follow a checklist). Let them know about the morale in your branch and be honest with them, especially if you get YAMAYA. Tell them how GCOM's tissue campaign is a waste of resources and time - Point out the stacks of boxes of tissues in the branch which aren't handed out because instructors and staff have no time (imagine how many jobs could have been saved if those boxes weren't ordered). Also inform them if your J-staff do not print your pay stubs (which they should) or forward to you any material which is now sent to them via e-mail.

NOTICE OF REGULARITY ALLOWANCE | PENALTIES FOR ABSENCES

[ Regulations and Conditions Concerning the Regularity Allowance, Absence and Lateness ]

Instructors should soon be receiving a document about the new regulations regarding regularity allowances and penalties for absences. It's either mailed to you, or it's sent to your branch's e-mail account (in which case the J-staff should print it out for instructor). Instructors must read and mail it back to their respective Foreign Personnel division. Make sure you ask your J-Staff to print it out for you if they already haven't! Instructors with new contracts will be the ones receiving it first, and then the rest of the instructors.

What does it all say? In short, if you are not late or absent, you get a salary rise but if you are absent... You're screwed! The wording of the document is pretty complicated but for example, if an instructor has 3 absences within a calendar month (without notification), their contract will be terminated or they will be offered a new contract with a 10% reduction in base salary for the remainder of their previous contract period. The same goes if an instructor is 10 minutes or more for a shift, 3 times a month (or late for a shift for 9:59 min or less/6 times a month).

There will also be deductions of salary from the Regularity Allowance (now YEN 40,000/month) - 1 absence with notification equals a cut of YEN 15,000 and so on. If you are absent more than three times a month, the 4th and following absences will be carried over and deducted from the following month.

The above will not apply if a medical certificate is provided. In short, if you get sick, go to the doctor as these people are serious about instructor attendance. They seriously believe that the instructors are at fault because of the student complaints regarding a lack of teachers! They're dellusional!

YAESU NOVA

Well, not surprising, the opening of the YAESU school today was a complete bomb! They had a total of about 7 calls and hardly any visitors. There are plans to open new schools in Shibuya, Shinjuku and Ginza next. One has to wonder if they'll get the word out for those schools.

"RENEWAL SCHOOLS"

This is what GCOM is calling schools that are going to be relocated to new (read cheaper) locations. Obviously they don't want to say they're relocating, so they've chosen renewal as the code-word for the branch's move to a new location. The students (and instructors) won't know until a week before the move and the "renewal" aspect will be pushed - i.e. It'll be a better school! There are a lot of schools that are going to be going through "renewals". Akita Ekimae went through it recently, and Chiba Chuo (ex-Honko) will go through it soon.

NEW CAPACITY RATIO

The old instructor/student is no longer the only criteria for instructor numbers in a branch. Effective immediately, a new capacity formula is in effect. If capacity is low in a branch, then more instructors will be put on standby. So, if your school is very busy but you only have one or two students per class, then your school will most likely have instructors be put on standby. Also, a formula for student tickets-used/month is in effect - this will determine the branch's sales rankings (and in my opinion is their first wise formula).

SALARY CUT ACROSS THE BOARD

It's true, and it's not just the gaijin staff. Every non-contract worker in the company is getting a salary cut - They'll get the pay of one level (or sometimes two) levels their current salary range. The company gives different pay scales with pay scale names such as "主管a", "主管b", "主管c" and so on... So, those getting a "主管a" salary will go down to a "主管b" salary which is less pay. The only people who are unaffected are the newly hired J-staff that are at the bottom of the pay scale.

At the same time, to lessen the shock of the salary cut, everyone is entitled to a YEN 5000 coupon at any G-Restaurant and a free night (with dinner) at the semi-luxurious G-Hotel and Resort in Shizuoka Prefecture (offer valid only on the employee's birthday month). Instructors are welcome to it as well!

NEW POTENTIAL ISSUE - FP TO BE MANNED BY CHINESE INSTRUCTORS

It keeps getting better and better at GCOM everyday!

Just to add about the wage-cuts posts made earlier: Inayoshi has decided head office budget has to be cut so it's sayonara to anyone that actually knows what they are doing! The foreign staff in Foreign Personnel have been given the option of a pay cut or being made redundant with a severance. If they decide to leave (and who wouldn't blame them!), FP will then be manned by Chinese language instructors who will be brought in from the branches or from standby. Apparently the reasoning is the Chinese instructors speak Japanese and "English" and are cheaper than FP staff since they'll keep their instructor salaries.

So, come April, if someone calls FP they'll probably have to deal with a non-native English speaker who won't have any idea what they're doing.

March 22

KIDS PROGRAM: No more Chibiko and the Kids material from 2005 (Vol. 1) will be reused. Originally there were plans to remake the LMPs for the KIDS program, but now old LMPs will be rehashed. Not all branches have the old books or know how to get them as they're in storage somewhere and nobody knows exactly where! Furthermore, the ordering system does not have the KIDS books on it.

FP/EQC: Education Planning is practially gone, as is the Tokyo FP (they all have taken redundancy as of the end of the month). Osaka FP will have fewer people as well.

BRANCH OPENINGS: In other news, Shibuya NOVA is scheduled to open on April 10th, Yokohama NOVA Ekimae on April 19th and Ginza NOVA on April 20th. All these schools will be in different (cheaper/less visible) locations. Who will man these schools when nearly everyone is gone?

Tack onto this, the General Union's hounding of g.com, the lack of an advertising campaign, problems with opening new schools, the continued use of a damaged brand, and general ill will from its instructors, and you have one giant train wreck in the making. Any takers on when g.com decides it's had enough and pulls the plug on neo-Nova?

MAY/JUNE PLUG PULL OR COLLAPSE

It is all over once they realize they made no cash in March and April. Mid-May will see the notice for closure going up in all but the very busiest branches. In short, unless the majority of your lessons have 5 students in them you'll be looking for work by end of May or late June at the latest.

If however April and May are really bad and G-com doesn't have any kind of escape strategy in place then it might just mean total collapse. In this case you won't be receiving your June or July paycheck. Which of these two eventualities occurs depends on just how bad at business this company really is.

A smart CEO is realizing he is fucked and putting together a bail out plan now. A stupid CEO is still issuing ridiculous statements and targets to his managers. So keep an eye on your AM and branch staff over the next 4 weeks and you'll be able to tell where it is going.

You have a choice. You can pull your own plug and save yourself the trauma of more lost salary or, you can put your faith in Japanese business acumen. I know where my money is.

When Nova first collapsed, I was pissed like everyone else but I see it now as a blessing in disguise. I opened up a small school with my old BT on the same day that G.Cunt opened its doors. Though we may not have as many students as they do, we're not doing too badly and are much more satisfied with our jobs.

At least now we CARE about going to work.

Although many of my friends decided to stick with Nova because they were either too damn lazy to look for new jobs, they tried to look but couldn't get one cos the market was flooded by surpluss teachers or they have faith in the system, I really hope that G.Cumm sink and die a languid death; mainly so I can get more students at my school of course.

If it hasn't already happened then soon all the failing schools will be put in a separate holding company, maybe offshore somewhere, with no strings back to the current organization and sunk. As for the original Nova, I think their collapse had a lot more to do with their shady business practices, market conditions, cash flow problems and they way they pissed off their students. They could always find teachers.

It is G-com employees as a whole who are due to take a pay-cut from May 5th. Thinking that the parent company is safe from the re-collapse of NOVA is blind. Tax Return

I did a Tax RETURN, on the very last day [St. Pat's Day] because I had to, by law.

By luck, I also got a Tax REFUND. It was nothing to write home about, but better than a kick in the teeth.

On a different note, seems to me that EVERYONE working for the G-Con-men started on or about 26, 27, 28 Nov 2007. That means PAID holidays will be kicking in about...well, the SAME BLOODY TIME for EVERYONE. And it's pretty soon...end of MAY, 2008! They'll be history by then, for sure.

They might have saved this heart-ache if they'd actually HONORED the old Nova contracts...Even total MORONS would have realized this.

Inayoshi was very proud to explain to the press that G-COM has no official lawyer because as they do a great job, they don't need one. I can hear people starting to prepare champagne over this news because they intend to sue G-COM and think they will succeed easily but in fact this is a bad news because attacking in justice in Japan take a long long time and it will take even longer if G-COM takes bad lawyers.

Most of Us Were Biding Our Time

Believe me, no-one's staying because they want to. At my branch even the staff are talking about finding alternative employment.

A lot of people, like myself, needed to ride it out until the hiring season which is basically now. Unemployment is a little more than half a regular instructors' wage and quite a few of us are supporting dependants. Apparently the job market is still flooded in the bigger cities, and of course there are fewer opportunities in outer regions between hiring seasons.

That said, all the teachers in my rurally-located branch have found new jobs and given notice over the last two weeks and it has well and truly halted the rapid growth in student numbers we saw since february, as none of them can book lessons for the next month. G.com is trying to convince teachers from Kobe to come here even though the Kobe branch has 15 teachers for more than 1000 students. I've heard that none of them are interested, and rightly so. If the branch closes or the company pulls the plug, they've got a better chance of finding something else in Kobe.

Have any of you been suddenly let go with out any notice? I got the final pay email today and called Tokyo and they tell me my last day is tomorrow. I thought we were supposed to be given one month... well it says that on my G con contract anyway.

The biggest cause of

The biggest cause of different tax burdens is timing. Your salary is based on the calendar year, and you pay tax on that. Eevryone gets a standard deduction, and very roughly, you don't pay tax on the first million yen of income (very roughly)

Most teachers know this means your first year of taxes is very low, as there is no local tax, only national.
In the second year, you MIGHT still have low taxes, depending on what month you showed up in Japan. If you showed up later, like in October, your "annual income" might be close to the million yen-ish line.
This mainly factors in to the insane local tax system, which is based on your income the year before last. So, none of us pay local tax in our first year, and in the second year, the local tax cut might still be small or zero, if you showed up later in the year.

The other major difference is just the withholding, some companies give you different tax withholding options when you join, so some people could get refunds, while others owe. Usually the eikaiwas make sure to withhold enough so you don't owe (who knows if you get all that's owed to you when you leave Japan)

It's the first time I've

It's the first time I've heard of that happening to anyone. It may be they made the decision earlier but failed to let you know? they are pretty disorganised. Contact the labour standards office, ask G.com to provide copies of whatever notice/documents they are supposed to have given you, and fax a translated email telling your buchou (area manager) that you're consulting a lawyer. That last point has helped instructors in the past, and they are definitely breaking the law. It might also be worth contacting your country's consulate, they might tell you the best way to get legal advice.

By the way, an email is a pretty low way to tell someone they've been let go isn't it? I've seen a few instances of outright cowardice from G.edu's managers.

To be honest, I really don't know exactly what gives with the income tax system, here. Without claiming any deductions (to reduce my taxable income) I'm getting close to ¥6,000 as a refund. In 2007, I got about ¥710, while a lot of friends got ¥8-10,000!

People I know who do a lot of private lessons and who are also *scrupulously honest* declare *every Yen* they receive from *every source*. They're getting several-to-many tens of thousands of Yen back as a tax refund this year.

The reason? They can claim textbooks, CDs, general books, newspapers; almost anything at all that relates to teaching English and staying abreast of matters in Japan and the wider world. Their tax accountants said they can even claim for coffee consumed when doing private lessons in cafes. You'd probably *need* a tax accountant to work all this stuff out, however.

When I did my tax return, the woman at City Hall who helped us was just looking up tables and bashing figures into a calculator at lightning speed. I was not 100% confident that she knew what she was doing. She asked no questions, just went on the figures from the docs I presented...and her judgment was that I didn't have to pay anything, so I was happy...The little refund was like a "bonus".

No severence. Robert from FPS told me on the phone last night that today was going to be my final day. I asked him about one months notice and he said NO. He said that they tried to contact me 10 days ago but could not get a hold of me so they have decided to stop my stand-by payments as of ten days ago and I am to be fired as of today. No time to get health insurance for my family or anything. I told him that I was looking at my contract and it says one month notice in writing. He said I would not get that. NICE

You are certainly entitled

You are certainly entitled to the one month severence but you might have to take some legal action to get it. Under the 'old' Nova, two people were sacked when I worked there and neither were paid the one month severence pay. The last I heard was one of them 'lawyered up' but then you have to judge the risk VS. reward (ie. cost VS. benefit).

I would put the pressure on FP and threten to sue as a starting point.

They have called me in for a meeting and asked me to bring my contracts ( G/old Nova). They said that it was standard to give one month notice no matter the situation was. The g-com dream will be over and out between June and October. All that is going on right now appears to be a desperate attempt to give it just one more try. I don't know the CEO but he is not stupid. He knows what happened to Saruhashi and he knows he'll be next in line.
I don't work for g-com but my advice for those of you wish to remain in Japan for some time: try and find alternative employment before it's too late.

TAX return

I'm gonna get about 20,000yen back in taxes.
Just go to the tax office, if you pay pension, health insurance, life insurance, or have dependants (spouse/kids) shows them some documentation, fill in a form (they will help you!!), and that's it. Oh, and you need to bring your hanko and bankbook as well (post office account will also do). They'll do the calculation on the spot, you'll get confirmation in wrting, but the actual payment might reach your account only 1-2 months later.

Legal Action

I'm not sure what neo-nova's policy is, but the old Nova used to pay out instructors all the time. If an instructor was fired or their contract wasn't renewed, and they sued, Nova paid them off every single time. Even if the dismissal was perfectly valid and Nova had a strong winnable case, the cost of going to court and paying their law firm for the hours of work is always going to be much higher than a couple of month's pay to make a disgruntled former employee go away.

So, even if they have legal grounds for letting you go in this way (it seems they don't, but even if they do), there's a very good chance you can squeeze a month or two of salary out of them just by beginning legal proceedings. They bank on the fact that people won't go through the hassle and time it takes to see results. If you can get a lawyer to represent you, and have the patience to see it through, you could get some money from the company in the future.

That being said, I don't have any idea what it takes to hire a lawyer, or how long the whole process would take, but I imagine G-ed has the same policy of paying people out rather than going to court. It makes financial sense.

Anyway, I've rambled long enough. I really feel for everyone who's been going through this ordeal, and those that are suddenly getting shafted again must be in a really bad place. Keep your chin up and know that things will get better when you're free of this awful situation.

Both of them were fired mid-contract. While you can argue that they deserved to be fired that is a moot point in this case. So it is not correct to say that 'old' Nova paid people one month severence after being fired.

These are two cases where I know the individuals involved (both happened at the Kashiwa branch in Chiba).

I still havent received the promised letter that they said I should have received yesterday. I have a meeting with the Labour Office on Monday and am in the process of contacting a lawyer as well. I have sent letters to the Union in Tokyo and in Osaka last evening. I will keep you all posted!

To answer the above question, one of them actually sued and took legal action and still did not receive their one month severence. That is, Nova "paid them off every single time" statement is factually incorrect.

RE: 1 month notice

they are bullshi**ing you.
1) They HAVE TO give you 1 month notice.
2) It is THEIR responsibility that this notie reaches you.

It's very uncommon to communicate those kind of things by e-mail or over the phone.
Usually they get it in writing, either hande over personally or sent by mail (usually registered mail).

In other words, as long as they have your current contact address, they can't claim they 'couldn't get hold of you'.

They are just trying to intimidate you or anybody who they believe haven't been in Japan long enough to know how things work.

Your options:
1) Go to your local Labor Standards Office. You don't need no f***ing union that just cost you money.
2) If you really got the balls, you can also go to s so-called small claims court (KAN-I-SAI-BAN-SHO in Japanese). They are all over Japan but relatively unknown. They are good for small claim (I think up to 1 million yen or so).
The good point of these court are:
You don't need a lawyer, you have to pay only a small fee altogether (about 5000yen), and they whole thing is over within about 2 months.
Some poeople tried that with the old NOVA. It didn't work at that time because NOVA filed for bancrupcy.
So as long as G-com doesn't file for bancrupcy your chances are high.
DISADVANTAGE: If G-com guys don't show up in court, they court might decide in your favor but these type of courts don' have power to enforce judgments. In that case, you would have lost 5,000yen and still no money for 1 month. G-com, however, would be put on some kind of credit black list for ignoring court orders.

I believe you could be thinking of the "three-week rule", perhaps...[?] When Nova instructors were starting out we had observations at 1-week and 3-week periods after finishing training.

The main reason for that was, that someone who was fvcking-up in lessons very badly, coming late or calling-in sick (whatever) in that first 3-week period, could be "let go" under Japanese law with no obligations on the part of the employer...The same applied to the employee, but that was never made clear to the newbies. They owed the employer nothing at all if they jumped ship in that period...It was (and is) a "grace period" for both parties to a new employment contract.

just to let everyone know how unethical and reprehensible g-scum can be, i was one of those people whose contract was not renewed because it happened to be up before april. they've been implementing the policy of terminating those whose contracts finish within the first 3 months of the year, though you'd have a hard time getting the shyster liars admitting it. anyway, after having multiple communications with different people in the organisation, in person, over the phone and via fax, with the intention of trying to get another contract, i finally had to stop going into work last week as they finally confirmed (on the last day of my working contract) that they would not be renewing it.they never had the decency to give me an unambiguous answer beforehand. i had no choice but to request the documents i needed to take to hello-work.

i received 2 letters from g-cumm today, one of them being a kind of reference, or a letter stating that i had indeed worked for them; the other being a shameless piece of deception, signed by a certain kuniko nakano (manager) stating that G-comm had released me, at my own request, from all obligations and responsibilities outlined in my nova contract.

at my own request, huh, kunero-tachi (for those of you that can swear in japanese); after all my efforts to get a new contract, they've got the brazen-faced insolence to claim that my termination was AT MY OWN REQUEST. this is the kind of incorrigibly scummish, low-life people we are dealing with. fuck them.

Walkout

I can't confirm this but I was told that several teachers at a Nova branch which include two instructors who have been dismissed without sufficient notice or explanation have "walked off" the job in protest. Some of the participants were instructors who actually got new contracts but are sick of what both workers and students are having to put up with.

I hope they stay home and more branches do the same. If I was a teacher or student at Nova I wouldn't go back too. Fitting 5 to 6 students in a cubicle... Isn't that a scaled down version of a sweat-shop?

SMALL CLAIMS COURT

Small claims court sounds like the go if you didn't get 1 month's notice, or if they ripped you off some other way. As said above, it only takes about 5000yen and 1-2 months to get it sorted.

NEW SCAM - G.com apartments

I heard from two friends that when they transferred to Nagoya they were provided with G.com apartments. Apparently they had to sign a lease on the spot which was written in Japanese (they asked for it in english but it wasn't provided) then later when one instructor left after giving a month's notice, 90,000yen was deducted from her last pay as a 'fine' for ending her lease early. I think that's outright theft.

One of my questions for quite some time now has been regarding the trustees and their choice of G Comm. Now, we have G Comm claiming to STILL be losing money by the bucket-load (how hasn't been explained, though they've certainly lightened their salary load substantially!). Wasn't there any kind of vetting process by the trustees which involved checking whether or not G Comm had the financial stamina to maintain life-support for, what was reportedly, the biggest financial collapse in post-war Japanese history?

So Tokyo FPS will no longer exist from tomorrow I was told today. I get a call from Osaka and this guy says to me... so you have decided not to work with us any more. I was like... NO you guys decided that for me. I asked him to please get his facts right before calling people. I guess any staff who have not taken the one month deal will be teaching tomorrow.
Also they pulled the plug on the Yokohama school . Could be they dont have the staff or teachers to open it. One of my Japanese friends refused to work/be transfered there. It is all down hill from here!

I heard from an ex-Nova student today that she tried to enrol at GCom in Sagamiono school. She was told there were 1200 students there and only 16 teachers and was refused.She was told to try Yokohama school. She refused.Good for her!Her friend who is a student there, told me it is difficult to get a lesson reservation."It was easier at Nova!"
